The circular letter of the Attorney General to United Siates Marshals con cerning the protection of voters in the coming election, says in the present condition of legislation the United States occupy a position toward voters and voting which varies according as the eleotion is one for State and local officers or lor Congressmen and Presidential electors. The election of representatives includes the election of electors to vote for a President of the United States. To secure voters against whatever in general prevents a full exercise of the elective franchise, whether it be registration or in the actual castidg of the ballot, and to protect the voter-againviolence on account of a vote cast or to be cast, is the duty of the Marshals. He therefore demands that Marshals prevent, a violation of the peace. Whoever violates the rights of voters breaks the peace, and makes it the duty of tho Marshal to arrest him. The letters notifies Marshals they will be he'd responsible for breaches of th9 peaoe of the United States, which diligence on their part might have prevented and for the arrest of violation of the peace. It auks that the Marshals be personally present or by deputy at all places of registration or election, where they may suspect the peace is threatened. Whenever special deputies be required in force, they can only be appointed iu cities of 20.000 or more inhabitants. The letter advises that each deputy and special have the right to summon assistance for quelling disorders committed by any person in the district above fifteen years of age, whether civilian or not, including militia, soldiers ' and marines, all of whom are bound to obey the laws. The fact that they are organized as military bodies of the State or the United States, and under the immediate command of their own officers, does not effect their legal character; they are still the posse comitatus. There is .no State law or Stale official in the country who has jurisdiction to oppose marshals in the discharge of their duties under the laws of the United States. They may disregard such interference entirely it it occurs.
