A Boyd, Gran-tec, Gran-tec, land hereinafter dr-signated as such) has the authority and consent of Ogden City, Utah and permission is hereby granted him, for a period of forty yean? from and alter his acceptance ac-ceptance of this franchise in writing, to construct, operate and maintain gas works in said City of Ogden. and, also, al-so, the right to lay (under the sur face) use and maintain in, through and nlong the streets, avenues, alles and other public thoroughfares now laid out and established, and any that may be laid out or opened in future within the limits of said City, gas pipes or mains, service pipes, curb boxes and the necessary machinery, apparatus, devices, attachments, ton-nectlons ton-nectlons and fixtures for conveying, distributing, supplying and selling gas for fuel, heat, power, Illuminating and manufacturing purposes to the inhab ifants, property owners, manufacturers manufactur-ers and users in said City, Sec 2 That the said Grantee, dur ing said term, be and hereby is vested with the rights and privileges of entering en-tering upon the streets, alleys, aven ues and other public thoroughfares of said city for the following purposes- To have the right and privilege of opening, laying and maintaining in the streets, alleys, avenues and other public thoroughfares which are now laid out, or an) that may be opened or laid out In future, In said City, all gas pipes or mains, service pipes, curb boxes and the necessary machinery, machin-ery, apparatus, devices, attachments, connections and fixtures for the purpose pur-pose of conveying, transmitting and distributing gas within the limits of said CItj for fuel. heat, power Illuminating Illum-inating and manufacturing, or an other commercial purpose for which the same may be used Sec 3. The price to be charged by the Grantee for all gas furnished under this franchise shall not exceed One and ten-100 ($1.10) Dollars for each one thousand (l. i cubic feet of gas consumed, as indicated by the meters me-ters provided by said grantee for measuring said gas for each consumer; consum-er; that all meters so installed shall accurately measure the Quantity of gas consumed, and that said meters will be kept r. repair and will be tested from time to time in order to keep them In repair and to determine the accuracy of the same. Art. 2nd That a discount of ten cents for every' one thousand cubic feet will be allowed on all bills that are paid on or before the tenth da of each and every calendar month fol lowing the reading of meter, making gns to all consumers, who so pay their bills, at the net price of One ($1.00) Dollar per thousand cubic feet; provided, however. that the Grantee shall have the right and privilege priv-ilege to collect from each consumer for each meter installed a minimum charge of fifty cents per month, whether a quantity of gas representing represent-ing that sum shall have been consumed consum-ed or registered or not. Art Trd That consumers will not be required or called upon to make any deposit on meters installed, but said Grantee reserves the right to satisfy sat-isfy himself as to the responsibility of each consumer who may make application ap-plication for gas and who wishes to become a user of the Grantee's products, prod-ucts, and the Grantee further reserves the right to remove the open meter and install a prepay meter In all cases where consumers do not mal e proper settlements Art. 4th That said Grantee shall not be entitled to any of the rights or provisions of this ordinance until he shall have filed with the City Recorder Re-corder of the City of Ogden. v it bin thirty days from the date of passage, his written acceptance of the same, and all of Its terms, conditions and provisions, and shall, before beginning actual construction, execute and file with the City Recorder a Bond in the sum of Twenty-five Thousand iL,r. oi i Dollars, w-lth corporate surety, to be approved by the .Mayor and Commissioners of Ogden City, conditioned upon the faithful performance perform-ance and observance of all the terms, conditions and provisions of this said ordinance Sec. 7 Said Grantee further agrees that on or before July 1st. 1913, he will commence work thereunder, and that he will prosecute the same with diligence, and extend gas mains and supply pipes to every part of Og den City as rapidly as lines will prove profitable, and the business obtained shall warrant Sec. 8. And as B further consideration considera-tion for occupying the streets, high ways and alleys and other privileges herein granted, as herein provided, the Grantee shall pay to Ogden City on its gross receipts, as an occupation tax. from the sale of cas and all of the by-products connected therewith as follows: 1st For the first five years no pnvment hereunder shall be made. L'nd For the next five years one half of I per cent. ;ird. For the next ten years 1 per cent. 4th For the next ten years 1 1-2 per cent ,'th. For the next ten years, 2 per cent. A statement, verified by the treas urer, or auditor, of the Grantee afl to its truth and correctness, showing th gross receipts for the year ending December De-cember 31st precediug, shall be delli . red to the auditor of the Grantor on or before the first day of February in each year; and the payment aforesaid afore-said shall be made on or before tho first day of M.m h In each year for the preceding year The books of the said Grantee, wherein are kept the records of sales of all gas and by pro ducts within the corporate limits of Ocden City, shall be open for inspection inspec-tion and examination by the City Vud tor of the Grantor at any time after the receipt of such statement, for the purpose of ascertaining the amouut of such gross receipts Sec 9. Said grnntee shall make and file with the City Engineer, or with such other designated officer as ma) bt- determined, plats or maps of all streets occupied by it. showing the size and kind of pipes installed, and the nature of the attachments there to. and upon the making of any additions, addi-tions, alterations or changes in any street occupied, shall li!e with said in Engineer, or other officer, maps or pints showing such alterations, changes or additions.
