Emil S Lund, first to make protest has announced that he will file an injunction suit In the Third district court, probably Monday, to prevent the building of the cross. The action will be instituted against the city commission and Bishop C W. Nib-ley, Nib-ley, who requested permission on behalf be-half of the Mormon church, to build the cross. Mr. Lund said that request for a temporary restraining order would be asked first and the suit pressed to have the Injunction made permanent The purpose is to enjoin the city commission com-mission from allowing the building of the cross upon public land, and Bishop Bish-op Nibley, as representative of the church, from procedlng with the erection erec-tion of the cross undor the permission permis-sion voted by the city commission.
