You have admitted that you have not supported the Board of Education in its policies. "5. You have authorized programs that were in opposition to the directives and programs set forth by the Superintendent. "6. You have failed and refused tc work ith the Superintendent in attempting attem-pting to overcome the educational short comings as set forth in the Superintendent's Superinten-dent's letter to you of 31 January, 1977. Your evaluation therein has not been changed. All of the adverse evaluations as set forth in that letter remain unresolved and are reasons for not tendering a contract con-tract for the coming year." "Mr. Elwell categorically denies every one of those charges," Collard said. "They're so vague they're unanswerable." unan-swerable." The attorney also said Elwell has never been supplied with a written document stating the reasons which provide sufficient justification for dismissal as is required by state statue. She stated that her investigation has failed to discover any such standards. The school district's counsel Oscar McConkie said these standards are on file but none of the board members or the superintendent knew where they were, according to Collard. The attorney said Tuesday night's hearing was not being recorded on tape and that the two district employes present admitted that they would not be able to transcribe the proceedings verbatim. ver-batim. She requested that next Tuesday's Sewer Petition Dropped Continued From Page 1 The sewer board was expected to go through legal channels in an attempt to have the withdrawal question settled before November but Trepanier's announcement last week clears the path for the bond sales. "It would be a big legal hassle," Trepanier said. "We can't afford it, maybe they can." The district opponent surprised the sewer board at its February 14 meeting when he revealed that the initiative petition was being filed. He said the purpose of the petition, co-sponsored by Donald Jay Alvey, Alvin ? According to Collard, the district's attorney at-torney McConkie acted as Goodworth's personal counsel during proceedings and both lawyers, along with Elwell and the superintendent,- had to leave the room while the board discussed Collard's motion to dismiss the hearing. , The board would not give reasons for denying the motion, Collard said. Having failed with the dismissal motion, the attorney said she next moved for a postponement on the grounds that she had insufficient time to prepare for the hearing. She said McConkie presented 27 exhibits as evidence which she had never had the opportunity to see prior to Tuesday night. The attorney also said said she asked the board to consider sending the matter to the Professional Practices Advisory Commission because charges of unethical conduct will be filed with that body against Dr. Goodworth. The school board agreed to postpone the hearing until June 8 Collard said but that date was unacceptable because she will be out of town. The board then settled on the May 31 date. The attorney said she would try to prepare Elwell's case by that time and noted that the board promised to provide her with the standards for dismissal. Commenting on Collard's actions during Tuesday's proceedings, Elwell said, ' 'She did a fantastic job. " to block the regional concept but not to stop an upgraded city plant. He contended the initiative would allow only Park City voters to make a decision on the regional plant with no votes being cast from outside the city limits. Major objections to the district listed in the petition included the $4.8 million cost of the regional plant ($3.6 million to be provided by the Environmental Protection, Protec-tion, a 49 per cent hike in service fees, expansion of the city plant at less cost, the use of general obligation bonds as opposed to revenue bonds, the decisive defeat of the bond election last June and supervision of the district by appointed rather tjiaji .elected, rffigials., .,,h ,,,. present situation and the alternative we face.
