(HRl permitted use allows for single family units on 37Vi x 75 foot lots and duplexes) on 50 x 75 foot lots. The proposed Norfolk subdivision would include duplexes built on 55 foot x 200 foot lots. ) Commissioner Bob Wells spoke of the greater impact of the possible voting down of this HRl zoned development. He said, "If it's a question of safety, we have expert advice. And this is an area which allows for more density than is proposed here. The basic question doesn't apply just to the Norfolk subdivision, but to the entire HRl zone in town. It's not a question of duplexes or 50 dwellings, but a test of the HR zoning. If it's turned down or modified, I feel it relates to the entire zoning question." After the project was rejected, Harry Reed reitierated this concern, "The question now is what can you do in HRl? Can the people who own property on Rossi Hill develop according to HRl? Can the older property owners in town development their land as planned according to HRl?" Aesthetics Underlying all of Priscilla Willard's reservations regarding the Norfolk subdivision was purportedly a matter of aesthetics. Seeing the project as "urban development in a rural area," she noted, "We have a development going up which is far worse than anything which has ever been proposed for Park City and we have the power to stop it. We don't want a bunch of people along the road to say 'look, we should never have allowed that building, we should never have allowed that road up there. It is in our interest that we preserve what Park City has. Aspen wishes they were in our position, where we have an ordinance and we should stick to it." Feeling that the proposed duplex housing would attract transients, she continued "Park City it full of skiers who come in here for 6 months. Hits Snag Continued From Paee 1 While presenting the contract for council perusal, Councilman Steve Dering told his collegues he favored the concept of a city-run Memorial Building but said the arrangement offered by the county would have to be modified. Under the terms of the agreement, the county would lease the building to the city for 50 years at $10 per year. The document called on the city to pay the county $53,000, the amount of the discretionary funds, "in the event of breach or early termination of this agreement by the city." . With the word "blackmail being bandied about, the council was unanimous in it rejection of this clause. Another provision nixed by city officials would allow the county to "make additions, alteration or modifications to any part of the building" with no city approval required. The discussion indicated that Council members Jan Wilking, Bennett and Dering would favor the takeover if the modifications to the agreement were made while Councilmen Jack Green and Richard Martinez expressed skepticism over the deal. "They want us to take over their liability," Green said. "That lumberman (Commissioner Dale Leavitt) is sitting back over there and laughing at us." Martinez contended the county should continue to provide maintenance funds for the building once the city begins supervision. Landslides One final argument against the project was presented in regard to rumors of landslides on the Norfolk Avenue hill. Park City resident Buddy Lang was called upon to speak on one such slide which "Killed a person, injured several others and took down several houses." He acknowledged, however, never having heard of mud slides "like the ones Mr. Kimball spoke of at the last meeting." Land developer Warren King spoke up saying, "I've read the history. There were alot of slides before the turn of the century because the mining people stripped every piece of vegetation off of the hill and fired their boilers and built their mine tunnels and built their houses. If you looked at a picture of Park City building at the turn of the century, it looked like a disaster area ; it looked like there'd been a major fire. But now the growth is back and it should stay." The Vote Prior to voting Chairman Watts read a letter left by vacationing Commissioner Greg Lawson in which Lawson listed a number of concerns: 1. the existing density of the proposed project; 2. parking problems; 3. a desire to see single family dwellings incorporated into the plan rather than duplexes. City Planner Van Martin made mention of a call he received from an attorney representing the opponents, Morton Siegal, warning the Commission that if they approved the developments on a preliminary basis that the Commission could be held liable for funds spent by the developers in the interim, should the proposal be rejected in the final vote. Siegal also passed the message that someone representing his firm with a construction background would send comment on the hill. Martin said, "He indicated concern for safety on the hill and the developers' seeming lack of experience." With the failure of the proposed subdivision, the developers met on Saturday and decided not to resubmit an altered proposal at this time. Jack Sweeney is scheduled to comment at this Wednesday's Planning Commission meeting. Page planner Max Greenhalgh at City Hall to rework the lease proposal. The two city officials insisted that the $53,000 breach of contract clasue be eliminated. "I can tell you for sure that there will be no agreement if that provision remains," Dering told Greenhalgh. Matthews asked that the contract stipulate that the county pay all telephone bills as well as electricity expenses incurred by the county offices. Other changes included city, rather than county, responsibility for the maintenance of the building's exterior, deletion of the county's ability to make alterations not appoved by the city, and deletion of the county's ability to sublease portions of the building. Added to the proposal was the stipulation that the county continue to provide four federally funded employes to operate the building and to supervise the recreation programs. The lease would begin August 1 of this year and would run until August 1, 2027. Greenhalgh took the counterproposal to the county commissioners for study and will try to return a revised contract to the city council by tonight. Following the Tuesday morning meeting, Dering said he hopes the two entities can reach an agreement. "Past actions clearly demonstrate that the county feels little responsibility for the appearance or condition of the Memorial Building," he remarked. "The building is on our Main Street and I would rather not depend on someone else to make sure it remains an asset to the community."
