This talk was said to have taken place in December, 1917, although the witness was not sure of the date when Attorney Leatherwod for the defense sought to pinn him down to a definite time as to when this statement was alleged to have been made. The next witness was a Mr. Parker from Trout Creek whose testimony was pretty much the same as the previous witnesses. Court then adjourned for the noon recess. During the noon recess the attorneys for both sides came to an agreement to end the preliminary hearing and submit the case without argument to the court. Judge Cooper was notified of this decision and on the of the court a few remarks were made by the attorneys of the action to be taken. Judge Cooper then rose and, amid intense silence, stated that the court fully sensed the duty resting on it and also the gravity of the situation, and that he would have liked for the case to have been argued in order to relieve the court of some of the burden of passing upon the merits of the evidence. However, he was fully convinced that the prosecution had produced enough evidence to bind the defendants over to a highfier court.
