Show """V Page Two - The Pyramid - June' 17, 1998 Reader says commission has overstepped authority Dear Editor: Merrill Ogden - ' - - A This letter is better addressed to Mr. Richard Prue, who ran an ad in The Pyramid Shopper edition dated June 3, 1998. Mr. Prue, I commend you for taking a stand against the Sanpete County Commissioners, but why did you give the impression that this was an issue of political significance between the republicans and democrats? As I read your article you were attacking the unconstitutional ordinances the commission passed, and this is admirable, and I agree with your stand 100 percent, but why do you feel republicans are the only people being violated, when in fact what the county commissioners did has violated every American citizens right to property in the passing of this policy of the county. When I read the proposed county ordinances pertaining to entering private property without permission, and without due process of law, destroy buildings and of government holding absolute control of private property, this puts me in mind of one of the nine planks of communism policy. This is to take control of all private property. Without too much imagination one might think, after reading this proposed county ordinance, we might have people in our government wanting to orient we the people to a communist form of government. If there is any doubt in what I say just read the new Sanpete County Zoning Ordinance. I .J4 . a The gardeners of Sanpete would appreciate a little drying Odds and Ends off brass seagulls. Well M-- Ive driven past the "pageant grounds" and seen some of the new sets which are being used this year. They look like large outcroppings of rock which are designed to open up and reveal the sets of home interiors and more. Its a clever idea that will give the show a different look. There are more chairs than ever set up on the lawn there in Manti. Im told that they will gradually over the next few years make the "blanket areas smaller and smaller as they attempt to accommodate more people. This will be a great year to invite your friends and relatives to visit us in Sanpete for a day or two. Take them to the pageant. Let them see the museum in Fairview. Go to a ball game. Take a drive in the green and gorgeous mountains of our area. Enjoy your la when you go to the ball fields. I believe that every game my daughter has played in this year has been in some sort of foul weather. Its rained. Its blown. Its been cold enough to freeze wings f . ,t ymm, out. The poor little sprouts m the garden think that theyre in Seattle or somewhere. Maybe its not too late to put in a planting of rice. The Mormon Miracle Pageant stans tomorrow night. The cast and crew have been rehearsing the past couple of weeks. They have been practicing in wet weather on a slippery temple hill so much that they wont know what to do if it doesnt rain during the performances. Remember people. Its only a game. It wasnt nuclear war between the United States and Russia (or India and Pakistan). It was just those millionaires running back and forth playing with a ball. The Jazz loss was a tough pill to swallow though. Even when things were looking good, I had to remind myself of who was on the floor. Michael Jordan just plain cant be counted out when theres time on the clock. The earth is still turning and Sanpete is still here demanding our living and working and playing. Its time to put our attention to the more important Sanpete games. Forget the NBA. Get on the bandwagon of the local baseball and soft-ba- ll league teams. Chances are you have family, neighbors and friends who are involved. Get to a few games and enjoy yourself. Remember to take an umbrel- 436-824- ' would have you take notice of the index making reference to chapter 11, notice the heading, quote INTERNATIONAL "Uniform and State Codes Govern, 11.6 INTERNATIONAL CODE FOR ABATEMENT OF DANGEROUS BUILDINGS, and 11.9 HOUSING INTERNATIONAL CODE". I ask you what have other nations codes got to do with the people of Sanpete County? Unless of course, we are being indoctrinated into a communist way of life, then I ask this question, what government body in Sanpete County is trying to do this indoctrination by subversive means as are apparent in this newly proposed control of private property? Found in the new ordinances. I would point out to you that when the Constitution was written the preamble didnt specify we the republicans, but said We The People", and that Constitution was written to control the power of government, and to protect the freedoms of the people from unjust institutions of lawsordinances to take our freedoms protected by that document. and proceed with impeachment proceedings to remove those officials (the county commissioners) from office. This is done through the judicial branch of government. I would suggest that if you have a following of people as I have heard you have, you first file for a declaratory judgement in the federal court, as to the Constitutional standing of those ordinances in question. And as I believe they are unconstitutional, yfcu will get a judgment in your favor. Then you charge those commissioners with misfeasance, malfeasance, of misconduct of office, as they have failed to comply with their oath to uphold the Constitution of the United States, and have them removed from office. There is a Utah State Statute for just such an action, or if you prefer you can go to a Federal Forum. My last word on the article is forget what party you belong to and join with all American citizens to fight this county commission in their effort to take away your Constitutionally protected right to property and remove any official from office that would pursue any communist doctrine to control private property without Constitutional due process of the law, and a right to happiness. There are laws; they can be removed, and if damage is done to any citizen because of their policy they are not immune from a law suit, although they think they have qualified immunity, they can be sued'hs an individual, and in their official capacity.
