Show who can legally use or ride in school buses the board of education has had several requests from individuals and organizations asking it they might ride on or might procure the school buses for certain purposes the laws of the state will not permit school boards to extend these privileges the following is taken from a letter dated september 26 1939 received from the public service commission of utah in the interest of promoting the me observance of the laws of the state relating to transportation by motor vehicle for hire and of promoting safety of mass transportation by motor vehicle and to be assured that neither school boards nor this commission may by being remiss in their duties permit a condition to exist that may leave upon such bodies any responsibility in the event of accidents to those who mav mar be conducting mass transportation movements without proper compliance with the laws of the state we call your attention to chapter 65 laws of utah 1935 this act grants to the public service commission general supervision of motor vehicles used for hire defines the type of operations which are subject to reau regulations lations and sets forth the means bychich by which any person owning and operating a vehicle for hire may obtain a permit from the commission to conduct such operation and specifies the extent to which the commission shall have jurisdiction briefly stated every motor vehicle operation conducted for hire in the state of utah with certain exceptions is subject to commission regulations and proper permit must be obtained before the operation ran can be legally performed one of exceptions Is found in 13 b no portion of this act aall apply to motor vehicles when engaged aa exclusively in transporting students or their instructors to or from school or to or from schoola activities the word school to io be construed to mean a place or structure in which the annual winter andlor summer elementary collegiate university or religious instruction is carried on it has been called to our oar attention t on that up and down the ahe state nearly everywhere school buses can be seen hauling persons other than students the public service commission feels that it is our bounden duty to enforce force the provisions of this act to the extent that these operations be discontinued or else that the persons conducting such operations make application for permits and secure proper authority to operate as s public carriers quoting again from chapter 65 section 19 every carrier to which this act applies and every person who violates or who procures aids or abets in the violating of any provisions of this act or who tails falls to obey any lawful order decision or regulation of the commission or who procures or aids or abets any person in his failure to obey such an order decision or regulation shall be deemed guilty of a misdemeanor the board of education would like to accommodate people of the county as they have done in the past but feel that in the best interest of everyone they should comply with the law |
