"In my opinion, if an elected officer moves out of the county, he vacates his position, Eliason said, and by doing so, his official actions may be void and set aside." Eliason delivered this opinion to the Commission in late October. In a letter to the Commission, dated November II, Eliason quoted Judge Harlan Burns as saying, If I moved from Iron County to Las Vegas, forthwith and immediately thereafter, every judgement, order, or decree entered by me would be a nullity. Judge Burns made the same obser- vation about other officers, Eliason slated in the letter. Eliason warned, " A taxpayer or person, including persons who were adversly affected by zoning changes, affected by vote on industrial bonds, affected by votes on budgetary regulations, may bring the matter into court to test the validity of any such commission order or decision, claiming that a vacancy existed of the removal from the county of Commissioner Ben Robison." Commissioner Robison, and his attorney, say Robison is still a resident of the county. In an interview, Commissioner Robison Garth White, Deputy Sheriff for Millard County recently returned from a 40 hour Crime Prevention Seminar held in Salt Lake City. This seminar was sponsored by the Utah Crime Prevention Council in conjunction with the Utah Department ol Public Safety, Utah Police Ollicers Standards and Training Academy and the University of Louisville, National Crime Prevention Institute. Michael Deamer, Robison's attorney, said he sent a letter to the Commission, dated October 21, stating that Robison has not abandoned his office, is in attendance at the meetings and is fulfilling his responsibilities, owns property in Sutherland on which he pays property taxes, and also was a qualified elector in the last election. whether The law deals with intent Robison is abandoning his residence, Deamer said. Deamer added, Certainly in my opinion, there is no willful abandonment - of the office." However, Deamer said, There is a legal question raised. It is a difficult question for the courts to answer, he said. "It depends on the statute and the intent of the parties." If there is a bond issue, the bond lawyers would force the issue. ..Other than that, I don't know whether anyone could make a case." Deamer did say, The County Commission is fully justified to relying on the County Attorneys opinion."
