Show Millard County Planning Minutes Following are the minutes of the meeting of the Millard County Planning Commission held Tuesday, June 22. 1982 at 8:00 p.m. at the Millard County Court House in Fillmore. Members in attendance: Leon Smith, Joyce Scottorn, Lenore Mont Snyder, Gardner, Leigh Maxfield and Lem Lovett. Also attending were Steve Young, Planner and Eldon Eliason, County Attorney. Lyman Finlinson was excused. Minutes of the previous meeting were approved on a motion by Lem Lovell, seconded by Lenore Gardner and carried. Time was given to Rex Stanworth from IPP for a presentation of photographs and a memento from the tour to the site at the time the railroad was brought on site. Mr. Rod Capel, Building Inspector, was in attendance to make the Planning Commission aware of a need in for provisions the ordinance to assess large scale utility lines a building permit fee. He indicated there would be many of these and they would impact services and there could be revenue generated should steps be taken by the planning commission. Atty. Eliason questioned whether the state might assess these or not. It was agreed by the planning commission members that they study this issue and make a decision at the first work meeting in August. Mr. Capel then addressed the issue of mobile home permits. He suggested improving the provisions in the ordinance by providing a list of instructions to mobile home owners. It was felt that implementing a set of rules covering mobile homes would offer more protection to fciV ft owners. The Planning Commission agreed to study this issue also and make a decision at the work meeting in August. A special concern to be studied would be wood stoves in mobile homes. Member Lovell presented plans from the 6th LDS Ward for a root cellar which would be built on north sandhill. It was determined that this was permitted use in the Residential Zone. The building would be about 24 ft. x 12 ft. and would be used to store vegetables. The building was approximately several hundred feet east of the Quin Shepherd coops, and would be made of cinder block and cement. A motion by Joyce Scottorn to approve this plan, seconded by Lem Lovell and carried unanimously. The Planning Commission approved two Conditional Use Permits for placement of mobile on the homes Bronson-Taylo- r subdivision, with conditions as follows: Conditions 1. That mobile home have permanent type skirting or foundation. 2. Documented approval of Water. 3. Documented approval of sewer. 4. Trailer must be properly anchored or tied down for protection against high winds. 5. Area should be clean and free of debri. The above approval was given on a motion by Joyce by Scottorn, seconded Lenore Gardner and carried. Jack Grayson was in answer to attendance complaints concerning sewage dumping, etc. which were discussed at the last meeting. He indicated he had secured all permits, and was not in violation of any ordinance or building code. He stated he had dug more than adequate drain fields and this was agreed to by both Steve Young, Planner and Rod Capel, Building Inspector. Mr. Grayson expressed a desire to clear this matter and said he would answer any questions. The Planning Commission expressed appreciation to him for making this special trip. Mr. Russell Olsen was present to propose a day care center which would be located in a Rural Residential Zone (Conditional Use Permit required) near Dr. Lymans home near the reservoir. There are .4 acres and the building will be approximately 2400 square feet. Each child requires 35 sq. feet indoors and 40 sq. feet outdoors. Atty. Eliason indicated that state requirements for day care centers were very strict and he 1 doubted the planning could commission add anything to their standards. Steve Young suggested that the Conditional Use Permit address the issues of parking, impact, access, fencing, etc. Mr. Olsen indicated that he must have approval to be able to secure financing. The Planning Commission members all agreed there was a definite need for this type of service in this area. Lem Lovell motioned that this concept be approved, along with a conditional use permit which will be prepared at a more convenient time, and Mr. Olsen must come back with a set of plans which have received state approval. This motion was seconded by Joyce Scottorn and carried unanimously. Comm. Maxfield suggested the that Planning Commission write a letter to the Commission requesting that the public hearing be held concerning the Oak City subdivsion. It was mentioned that this hearing had been promised before the County Commissioners approve or deny the request for this subdivision. The secretary was instructed to write this letter on a motion by Mont Snyder, seconded by Joyce Scottorn and carried unanimously. Steve Young pointed out an oversight in the ordinance and stated he had cited two trailers which were being used to house night watchmen at a He site. construction suggested amending the ordinance and making such use conditional so proper sewer and water hookup could be assured. A motion by Joyce Scottorn that a letter to the County Commissioners recommend that Steve Young be instructed to draft an ordinance amendment to allow trailers as a conditional use for night watchmen at construction sites, seconded by Lenore Gardner and carried unanimously. Don Daly, Steve Pace and Randy Day were present to propose approval for a Conditional Use Permit which would allow them to build a lounge which would provide recreational facilities in a licensed, controlled and managed environment. They indicated a desire to work with county officials and stated that the Sheriff had looked over their plans and expressed confidence in their to handle any ability situation. This would be in a Highway located Commercial Zone which allows this use as a Conditional Use, just past the Cheese Plant. It was suggested that property owners be contacted and Mr. Daly indicated he had talked to most of them. He said they had approval from UDOT at Cedar on road right of way and parking. Mont Snyder made a motion that we approve the concept, study, and have Eldon Eliason, Steve Young, Leon Smith and Don Daly write a Conditional Use Permit so they could proceed with their plans and secure financing. Seconded by Lem Lovell and carried. Grayson Roper and Paul Pearson and Dave Roper were in attendance to go over the requirements on their premliminary plat. They were because the concerned Planning Commission was not going to hold another meeting before July 27, and they would be ready to proceed prior to that time. Joyce Scottorn motioned that Steve Young be given authority to look over the plans and recommend them for approval to Leon Smith. Seconded by Lem Lovell and carried. It was mentioned by Steve Young that Mark Jacobs, Mike Christensen and Mike were again in Barney violation of the ordinance because they had rented office space to Petty-RaGeothermal Co. They were presently in the process of petitioning for annexation which would alleviate the situation if they were approved. This was discussed at length with members for hope expressing annexation. The last item on the agenda was discussion of a refund on the Larry Burg dairy, which was not going to be built. Atty. read an opinion which mandated that the Planning Commission could not legally approve a refund, especially since an inspection had already been made. The Planning Commission, on a motion by Lenore Gardner, seconded by Lem Lovell, agreed that this matter should be handled by the attorney and the County Commission. A motion to adjourn was made by Mont Snyder at 10:20 p.m. seconded by Lenore Gardner and carried unanimously.
