County Fourth District Criminal Court Oct 23 in Fillmore All defendants are legally presumed innocent until proven guilty beyond a reasonable doubt A waiver bearing was scheduled for Dec 4 for Kendell G Hatfield who is charged with a felony count of DUI The count was enhanced to a felony because Hatfield has bad three previous DUI convictions since April of 990 A preliminary hearing was scheduled for Nov 21 for Manuel H Ramirez of Fillmore who is charged with two felony counts of rape of a child and aggravated kidnaping The charges stem from an alleged June incident The Justice of the Peace previously set bail at 130000 Schofield reduced bail to $10000 If Ramirez is released on bail he may not leave Millard County unless it is to work and he is under his employer's pervision He was ordered to have no contact with the victim or her immediate family and he may not be in contact with anyone under the age of 8 Ramirez was also ordered to maintain hill time employment Froy Ian Padilla 18 and Manuel Padilla 19 were arraigned on drug charges An preliminary hearing was set for Nov 2 Both are charged with a felony count of distribution of involving a minor a felony count of distribution of marijuana and a class B misdemeanor count of possession of drug paraphernalia Both defendants are free on bail A preliminary hearing was scheduled for Nov 7 for John M Sandoval 19 of Las Vegas Nevada Sandoval is charged with a felony count of possession of a stolen 1997 Nissan Altima and two class C misdemeanor counts of driving without a valid driver's license and not having proper vehicle registration The charges stem from an alleged Oct 12 incident Bail has been set at $3000 Gary W Freeman entered at plea in abeyance agreement on a class A misdemeanor count of issuing two bad checks Under terms of the agreement Freeman must pay restitution within six months He is jointly responsible with a in the case He was also ordered to pay a $100 pica in abeyance administrative fee and to spend six days in jail He was given credit for six days already served If Freeman successfully completes the terms of the agreement the charge will be dismissed in two years If he is not successful Freeman could face up to a year in jail Scott L Stanworth failed to appear for conference on a class A misdea meanor count of domestic violence Stanworth’s attorney Jim Slavens of Fillmore said a plea in abeyance agreement had been planned Schofield continued the conference to Nov 7 If Stanworth does not appear then a bench warrant will be issued for his arrest A waiver hearing for Douglas L Francom and Lisa A Anderson was continued to Nov 7 Both are charged with a felony count of possession of a controlled substance two class B misdemeanor counts of possession of a controlled substance and possession of drug paraphernalia two class C misdemeanor counts of having an open concomtainer of alcohol inside the passenger partment of a motor vehicle and having a tinted windshield and not wearing a seat belt which is an infraction Rodney W Newby of Hinckley failed to appear for an order to show cause hearing He is accused of violating terms of a plea in abeyance agreement which he tered on a felony count of child abuse Schofield continued the hearing to Nov 7 If Newby doesn’t appear at that time Schofield said a bench warrant for his arrest will be issued If Newby is found in violation of the plea in abeyance agreement he could face years in prison An order to show cause hearing for Shawn R Hansen was continued No new date was set Hansen had apparently not been served with a notice of Thursday’s hearing He is accused of allegedly violating terms of his probation He’s on probation for a class B misdemeanor count of reckless driving and a class C misdemeanor count of having an open container of alcohol inside the passenger compartment of a motor vehicle of Michael W Searle of St Sentencing George was continued to Nov 20 He’ll be sentenced on two class A misdemeanor of counts supplying alcohol to minors and criminal mischief a class C misdemeanor count of having bad or no brakes and not wearing a seat belt which is an infraction Searle entered a plea in abeyance agreement on a class B misdemeanor count of DUI Rodger D Jeffery's sentencing was continued to Nov 20 He’ll be sentenced on a felony count of Sentencing of Brenda J Rhodes was continued to Nov 7 on a felony count of distributionof marijuana James G Burns’ sentence was He is serving time in the Millard County Jail on two felony counts of possession of a controlled substance Bums works cm the jail inmate work crew and has been working on the jail expansion project Sahara Construction Company the contractor of the project has reportedly offered Bums a job Bums asked for work lease so he can get paid to work on the project SlieriffEd Phillips apparently has some reservations about Bums participating in work release on the project Dexter Anderson didn’t object to work release as long as Bums does not work on the jail expansion project Schofield approved work release as long as Bums will not work on the project Bums was given five days of work search release Any job he gets must be approved by the Utah Department of Adult Probation and Parole (AP&P) Schofield told Bums that as soon as his jail sentence is over he may work wherever he wants as long as AP&P approves of his choice An evidentiary hearing on an order to show cause against Melvin E Dyer was continued to Nov 20 The hearing is to consider accusations that Dyer violated his probation He is on probation in a 1995 case involving a felony count of forgery Stephen R Miller was bound over for trial after a preliminary hearing on two felony counts of assault by a prisoner and forgery and a class B misdemeanor count of theft The case was assigned to Judge Guy Bumingham A trial date is pending A vehicle belonging to Artemas C Shydian was forfeited to Millard County after a hearing Shydian was involved in a drug case in which he was charged with a felony count of possession of a controlled substance and a class B misdemeanor count of possession of drug paraphernalia A preliminary hearing for Mark E and Kenneth C Yarbrough was Campbell continued to Nov 20 Both are charged with a felony count of possession of a controlled substance with intent to distribute Capt Dekker receives state award Derin Phelps Capt Robert Dekker of the Millard County Sheriffs Office received the Roger B Jones County Corrections Award for his cooperation with the State Dept of Correction as administrator of the Mil'Wd pouryy jil in frllmprt “i think it's a true reflection on Robert s skills In his assigned dwtiesr MidMilhrd County Sheriff Ed Phillips Dekker received the award at a Sept 26 banquet of the Dept Of Corrections in Salt Lake City As jail administrator Dekker worked with the state in housing state prison inmates "The state has some special housing needs that sometimes we can fulfill better than other facilities" Dekker said The inscription on Dckker’s award states: “As jail commander Capt Dekker has been extremely helpful to the Utah Dept of Corrections often approving inmates with exigent circumstances on extremely short notice and working with all of the state inmates in a professional manner” Dekker has been the jail administrator since 1994 His job involves management of the jail facility and its staff inmate transportation housing and coordination of bailiff services for Fourth District Court in Fillmore "I didn't know anything about the award until I received a letter from them" Dekker said Dekker was nominated for the award By Derin Phelps The Millard County School Board cided not to release names of high school students to the US Armed Forces The matter was discussed at the Oct 3 regular school board meeting at Millard High School in Fillmore The Armed Forces requested the names of all district juniors and seniors to be used for recruiting purposes School Board member Kay Gardner said she thinks allowing Armed Forces personnel time with students on Career Diy is enough contact In other action two boundary change requests were approved Parents of two students asked that they be allowed to remain at Delta North Elementary School The family recently moved to an area south of Main St so they are in the boundary of Delta South Elementary School Several personnel items were discussed some in executive session The school board voted to hire Valene Harris as a Gifted and Talented teacher She was selected from a group of three applicants interviewed Seven substitute teachers were approved to be hir'd The list cludes Deanne Mitchell Lori Bunker Diane Wardle Joyce Knight Bethany Atkinson Rebecca Winsor and Catrina Robison School board members voted to refer a ninth grade student to Fourth District Juvenile Court instead of allowing him to attend West Central Valley School in Delta The board approved hiring Beverly Thatcher of Scipio as a part time lunch worker at Fillmore Middle School and school board approved the meeting schedule Requests for field trips from Millard High School were approved with some amendments Trips to the Springville and BYU Art Museums in March were approved as well as one trip to Provo quested by the FHA Club The FHA had requested two trips A request for art students to take a trip to an unknown site in November was not approved It will be reconsidered when a definite location is requested Two requests for fundraisers were proved including one submitted by the Millard High School FHA Club to sell doughnuts The board also approved lowing Delta High School Swimming Coach Tom Hamilton to donate his coaching salary to the swim team Delta South Elementary School requested permission to sell Easter candy Me Donald's in Delta would be a cooperating sponsor and a coupon would be included on bars of candy Superintendent Dr Kenneth Topham said he would talk to Delta South Elementary School Principal Mitch My era about the request Topham said he wants to make sure there will be no selling The board approved a request by the Boy Scouts to use Delta High School for a merit badge pow wow March 7 and 8 1998 The Scouts will use a large meeting room 20 classrooms a chalk board and other school materials The Scouts will pay the cost of cleaning the school after the pow wow andor help the school cus- - “Delta City Light Parade plans underway clean Millard County Commissioner Lana Moon reported her concerns about a new Utah History textbook for fourth grade students The book is currently bang used in Millard County Schools Moon had some concern about the w ay environmental issues and other topics were presented A Sate committee on textbooks will view the book in December After that meeting die Chronicle Progress will have a detailed report about the book Enrollment reports for the School Year is in and Topham reported is declining He said if the trend enrollment continues the district may need to eventually reduce its work force The superintendent said he hopes this can be done through natural attrition “Our decline is greater this year than we thought it would be" Topham said Total school district student enrollment last year was 3829 students This year shows an 89 student loss with a total enrollment of 3740 students Losses are being seen at all of the district's elementary and middle schools as well as West Central Valley School Delta and Millard High Schools show an increase in students with 16 more at MHS and 24 additional students this year at DHS Enrollment at the Gamson school has remained constant with 16 students The next meeting of the Millard County School Board is this Thursday at am at Delta High School The public is
