PROPOSED RESOLUTION NO A RESOLUTION OF THE MILLARD COUNTY PLANNING COMMISSION ADOPTING CERTAIN AMENDMENTS TO THE MILLARD COUNTY MASTER PLAN RELATING TO INDUSTRIAL DEVELOPMENT WITNESSETH: The Millard County Planning Commission referred to herein as the "Planning Commission" hereby recites the following as a summary of its basis for adopting the resolution set out herein A The Planning Commission has previously adopted a Master Plan pursuant to Utah Code Annotated Chapter 27 tle 17 The master plan adopted is entitled "Millard County Comprehensive Development Plan" B The Planning Commission recognizes and finds that the diversity of economic tivity experienced by Millard County and ticipates future economic activity including the development construction and operation of industrial facilities C The Planning Commission finds that the technological complexity and potential impact of industrial facilities requires detailed review of proposed facilities to determine their effect on local governmental services and the physical and natural resources health safety morals order convenience prosperity and general welfare of the habitants of Millard County and on the human environment The Planning Commission has further found after detailed and extensive discussion that during its meetings the Millard County Comprehensive Development Plan (hereinafter referred to as the "Master Plan”) and the existing Millard County Zoning Ordinance not provide for adequate review of proposed dustrial development nor for a permit prowith cess to establish and assure compliance necessary standards D The Planning Commission finds the previous policy of encouraging industry to locate in designated industrial parks is not economically practical for Millard County does not provide adequate review of specific site conditions and may improperly vest the decision of selecting industry locations in the hands of industrial park owners rather than full review of relevant siting criteria allowing by the developer of industrial facilities and more significantly by the Planning Commission Also the previous policy of couraging industrial park locations does not allow for full consideration of adverse pacts from industrial development E The Planning Commission further finds that the previous practices of siting dustrial uses in the Range and Forest Zone under conditional use permits or as permitted uses contradicts the stated purpose of conserving low densities in such zones A more suitable process for locating industrial facilities should therefore be established F The Planning Commission finds that the amendments set out in this resolution promote the best interests and the health safety morals order convenience and prosperity and general welfare of the habitants of Millard County as well as providing for more efficiency in the process of and a procedure to assure more development efficient and economic utilization and conservation of resources G The Planning Commission further of the Master Plan finds that Section recommends that the plan cover a period from 1980 to 1990 while Section 2 of the Plan recommends major revision every two to five years The Planning Commission also finds that the Master Plan as presently amended should be ratified and confirmed for the present purposes of zoning in Millard County NOW THEREFORE BE IT RESOLVED by the Millard County Planning Commission as follows: Section Amendment to Section 4 Goals aad Policies That portion of Section 4 titled "Goals and Policies’ and labeled of the "INDUSTRY" found on page Millard County Comprehensive Development Plan is hereby repealed in its entirety and the following adopted in place thereof: GOAL To encourage industries to locate in Millard County to utilize products and resources and to participate in commerce in a manner that will its Millard County benefit and inhabitants municipalities tax through economic development base diversification suitable vironmental protection and employment benefits The following policies are adopted to promote these general goals: To encourage industrial development 2 To encourage industrial development in a manner compatible with surrounding land uses and neighborhoods that are 3 To encourage industries not tied to resources unique to a site to locate within urban into annex or to centers specific municipalities in order to stabilize their municipal tax base unless such industries are determined to be unsuitable for location in urban areas or municipalities 4 To encourage feedyards dairy industry and other intensive agricultural use that can utilize alfalfa hay feed grains and other locally produced farm products 5 To encourage the development of natural resources 6 To encourage industries that utilize natural or other resources located in Millard County to design their industrial facilities processes and practices to utilize the most effective procedures and technologies reasonably available to prevent or reduce harmful or deleterious effects to the human environment GOAL II industrial uses that may Heavy affect residential or comadversely mercial uses and the human environment yet are valuable for providing services employment tax base and resource utilization should be couraged to develop but only after careful review or proposed facilities procedures and locations to assure adequate mitigation of adverse pacts Therefore Millard County should: Encourage siting of heavy dustrial uses in proximity to similar uses where possible and provide for land protection of uses 2 Provide flexibility through "floating zones" or other zoning that permit site specific techniques review and enable mitigation of adverse impacts while permitting use of resources to a given specific location 3 Encourage conditional use permits and similar reviews so that proposed heavy industrial use receives careful balanced consideration 2 A mend menu to Section 5 Section "Future Plans" of the CompreheusKe Development Plan The subsection entitled "Industrial Land Use" of Section 5 entitled "Future Plans" of the Comprehensive Development Plan as found on pages thereof should be repealed in its and tirety and the following should be adopted in its place: 3 Industrial Land Use a Description The types of uses to be developed in industrial areas clude wholesale trade bulk sales distribution transportation dustry manufacturing mining rock crushing electrical generation and transmission facilities raw materials processing industrial byproduct disposal hazardous waste disposal solid waste disposal agricultural goods production and services tivities This zone should not be deemed suitable for handling processing or storage of nuclear sionable or radioactive waste b Locational Considerations The considerations should be following given to the location of industrial land uses: sites should be generalIndustrial ly level typically with not more than five percent (5W) slope or capable of being suitably graded without undue expense - Industrial sites require good cess to commercial transportation facilities such as railroads or major trucking routes Industrial sites should be located within easy commuting time of labor force residential areas and accessible to major transportation and commuting thoroughfares - Locate where compatible with or buffered from surrounding uses - Locate where necessary to utilize existing natural or other resources - Such uses should be located when possible adjacent to other similar uses whether such uses lie within the incorporated areas of Millard County or within adjacent incorporated municipalities - Locate with good access to elecutilities or trical and other necessary where such utility services can be tended by the developer Section 3 Master Plan Ratified The Millard County Comprehensive Developmnt Plan as amended to date including the amendments set out in this resolution is hereby adopted a ratified as the Master Plan for Millard County Utah Section 4 Effective Date This resolution shall become effective immediately upon adoption 5 Conflicting Actio as This Section resolution shall be deemed to supersede any prior or conflicting resolutions actions or practices of the Millard County Planning Commission 6 Section Implementation and aistratioa The Millard County Planning Commission
