DEED CONVEYING SAID PROPERTY The City Council of the City of Delia Utah referred to herein as the "City Council" recited the following as the basis for enacting this ordinance: A The City Council has received a petition from owners of properties in Block 92 and Block 93 of the Amended Plat of Delta Townsite (Plat "A") according to the official plat thereof petitioning for vacation of a portion of Second East Street lying ween Blocks 92 and 93 that portion also as the South 1040 feet of that ing described portion of Second East Street lying between Blocks 92 and 93 of the Amended Townsite Plat of Delta Utah (Plat "A") according to the official plat thereof B The City Council after review of the Comprehensive Development Plan for the City of Delta and other recommendations from the Delta City Planning and Zoning Commission and after determining that the portion of the street for which vacation has been requested has not been used by the City of Delta as pan of its street plan has determined that there is good cause for vacating the portion of Second East Street as requested C The City Council has determined after careful consideration that the vacation of the street in question will not be detrimental to the health safely welfare or general interests of the residents of the City of Delta D The City Council is empowered under Utah Code Annotated Section as amended to adopt ordinances (1953) providing for vacation of streets within the City of Delta upon receipt of a petition therefore and upon consent from the owners of the property abutting the part of the street without the necessity to be vacated of publishing notice or holding a public hearing on said vacation and consent has been received from the owners of all property abutting the portion of the street to be vacated in the form of petitions for vacation of the subject street NOW THEREFORE BE IT ORDAINED by the City Council of the City of Delta Utah: Street Vacation A certain portion of Second East Street lying between Blocks 92 and 93 in the City of Delta Utah of the Amended Plat of Delta Utah (Plat Townsite "A") according to the official plat thereof in the office of the Millard County Utah Recorder as described more particularly is hereby vacated below as a Delta City The portion vacated is described as street follows: The South 1040 feet of that portion of Second East Street lying between Blocks 92 and 93 of the Amended Townsite Plat of Delta Utah (Plat "A") according to the official plat thereof 2 Effect of Street Vacation This ordinance shall not effect an abandonment or for drainage vacation of any easements mainsewer water lines or other easements tained by the City of Delta which may be presently located within the described street The vacation effected hereby shall
