Show Ordinance No 84-8- 6 AN ORDINANCE ACCEPTING DEDICATION OF CERTAIN PUBLIC STREETS AND RELATED IMPROVEMENTS WITHIN THE WHITE SAGE DEVELOPMENT IN THE WHITE SAGE ANNEXATION TO DELTA CITY AND APPROVING AN AMENDMENT TO AN ESCROW AGREEMENT BETWEEN INTERMOUNTAIN POWER AGENCY AND DELTA CITY TO PROVIDE FOR COMPLETION AND WARRANTY OF SUCH STREETS AND RELATED IMPROVEMENTS RECITALS The City Council of the City of Delta Utah referred to herein as the “City Council” hereby recites the following as the basis for adopting this ordinance: A Intermountain Power Agency (referred to herein as “IPA”) as part of its overall impact alleviation program constructed the residential and recreational development located in the White Sage Annexation area in the eastern portion of the of Delta compresent corporate boundaries monly referred to as the “White Sage Development” As part of said development IPA has constructed roadways and street improvements which have been approved as part of the Delta City Master Street Plan B Delta City has agreed to accept dedication of the public streets and related provements on the conditions that the be completed to Delta City conprovements struction standards as set out in the Delta City Subdivision Ordinance and that IPA provide an escrow for a period of one year after the date of acceptance by the City of said improvements with sufficient funding to assure that any repairs or replacements as might be necessary due to defective construction of said improvements can be completed C IPA has previously entered into an agreement with Delta City and Zions First National Bank providing for an escrow in the amount of $123500000 to guarantee the public improvements in the White Sage Subdivision and the street and related in the balance of the White Sage provements Subdivision but the agreement as executed on August 15 1983 failed to definitively declare that the Escrow Agreement also apto these street and related plied provements located within the White Sage Development outside of the White Sage Subdivision D IPA has substantially completed construction of the street drainage sidewalk and related improvements in the White Sage Development and IPA and the other owners of lands located along the streets improved by IPA within the White Sage Development have offered said streets and related provements for dedication E City Council has determined that if the escrow agreement referred to above is amended to guarantee that street and other improvements that the best interests of the residents of Delta City will be served by ceptance of said streets NOW THEREFORE BE IT RESOLVED by the City Council of the City of Delta Utah: Street Dedication Accepted The offer by IPA and other landowners within the White Sage Annexation to dedicate to Delta City the streets and other public areas and the improvements thereto shown on the Street Dedication Plat for White Sage Avenue attached hereto as Exhibit “A” the Street Dedication Plat for Locust Avenue East) attached hereto as Exhibit “B” and the Street Dedication Plat for Birch Drive Manzanita Avenue Pinon Avenue and Ponderosa Drive attached hereto as as part of the hibit “C” are hereby accepted public street system of the City of Delta Authorization is given for the City Attorney to provide for recordation of the original of said street dedication plats in the office of the Millard County Recorder The streets (700 accepted hereby shall be named as shown on the dedication plats attached hereto 2 Condition Upon Acceptance of Dedication The acceptance of dedication of the streets described in Section is strictly conditioned upon fulfillment of the terms of the document entitled “Escrow Agreement” entered into by and between IPA Zions First National Bank and Delta City on August 15 1983 a copy of which is attached hereto as Exhibit “D” as such agreement is amended by the document entitled “Amendment to Escrow Agreement” tached hereto as Exhibit “E” 3 Escrow Agreement Amendment Approved The amendment to the escrow agreement referred to in Section 2 of this dinance a copy of which amendment is tached as Exhibit "E” to this ordinance is hereby approved and authorizaiton is given for Delta City to enter into said Amendment to Escrow Agreement and for the Mayor and City Recorder to sign and attest respectively the Amendment to Escrow Agreement on behalf of Delta City Responsibility for management of the escrow agreement and the amendment thereto on behalf of Delta City is hereby delegated to the Mayor with the assistance of the City Manager and such other City personnel as the Mayor and Manager may direct 4 Approval of Street Improvements The Delta City Engineer is hereby authorized and instructed to make such inspections and tests as are necessary to determine whether the improvements to the streets dedicated as described in the plats attached as Exhibits “A” “B” and “C” hereto have been made and are complete in accordance with the terms of the Delta City Subdivision Ordinance Upon certification by the City have been Engineer that such improvements made and are complete in accordance with the Delta City construction standards as set out in the Subdivision Ordinance the provements shall be deemed as “accepted” as the term is used in the Escrow Agreement and the Amendment thereto 5 Effective Date This ordinance shall become effective upon publication 6 Publication This ordinance is ordered published in the Millard County Chronicle Progress a newspaper having general culation within the City of Delta Utah 7 Severability In the event that any provision of this ordinance less than the entire ordinance is held invalid by a court of competent jurisdiciton this ordinance shall be deemed severable and such finding of validity shall not affect the remaining portions of this ordinance 8 Conflicting Ordinances To the extent that any ordinances resolutions or policies of the City of Delta
