Show Page 2 Millard County Chronicle Progress January 4 Comments I know I promised to get on the ball and get my series on Taiwan underway but I haven’t done so yet Monday holidays just have me so confused I haven't known what day of the week it is since about December 23rd I’m not going to promise but maybe next week I can get the series started It is frustrating to type w ith one hand not that I am real great with two so that has also made it real easy to use that as an excuse I want to begin the scries with their first Democratic Election as that is why I was their guest So I have been 122Q Media Man! Anthony Archuleta 1989 Continued 'Ihe original idea was to have a popular vote on each siting application but that approach was found to be legally weak The alternative was an “advisory" vote It would not be legally binding but Commissioner Mike Styler said it would be “politically binding" In May County Attorney Warren Peterson was accused of sandbagging preparation of the ordinance for voter approval Peterson rejected the notion citing his current caseload which cluded three homicide trials pending and a major tax lawsuit involving IPP among other tasks A Salt Lake law firm was asked to draft an ordinance It was discussed by the Planning and Zoning Commission in July and County Commissioners viewed the draft in August and again in September Just before the election in November it was reported that the vote may not be constitutional A court in another state ruled that popular sentiment alone was insufficient cause to deny a siting permit But on Nov 7 voters made it clear what their sentiment was: PROHIBIT rather than PERMIT The margin was about Rollins announced plans to abandon Millard County and build near Green River As he had promised Commissioner Mike Styler took the wishes of the voters to the Planning and Zoning Commission in December and requested the appropriate change in the county Master Plan To the shock of the group of citizens who had fought to prohibit hazardous waste in the county the Commission rejected the requcsL Styler said the County Commission could bypass the PAZ Commission as P&Z had bypassed the voter referendum and rule on the issue That action ia expected to happen during the first month of 1990 On May 26 1989 Nancy and David Church received the first annual Gordon R Church Memorial Award from friends of the SUSC student They received their son's posthumous bachelor’s degree in theater arts on June 3 Gordon Ray Church was murdered Nov 22 1988 A few days later Michael Anthony Archuleta and Lance Conway Wood were arrested trial separately Both pleaded innocent Archuleta was assigned to Judge George E Ballif Wood was assigned to Judge Boyd L Park The press and public were excluded from the preliminary hearings on the order of Justice of the Peace Ron Hare The order was reversed Oct 23 and the transcript of the hearing ordered released to the public Archuleta's trial began Nov 16 Jury selection was conducted behind closed doors in Provo It waj interrupted by the Thanksgiving holiday and delayed by several legal actions The trial itself began on Monday Dec 4 The jury went out Friday Dec 15 and returned more than eight hours later with the verdict of guilty of murder in the first On Wednesday Dec 20 the degree same jury that convicted him sentenced Archuleta to death Execution date was set for Feb 19 1990 but
