misconduct?” he said “Is there sufficient prejudice that would merit a new trial?” Metos did not fault efforts by the court to run a fair trial “The court tried everything that it could to avoid this incident" he said “but it happened anyway” While Metos conceded that “other jurors did not see the contents of the article until after the deliberations were over and a decision had been made” he believed the juror that brought the article into the courtroom had seen it “The state cannot meet the burden of overcoming this prejudice” Metos said “It's an article that should not have been written in the course of the trial” At the time it first appeared Millard County Attorney Warren Peterson said he and the court were upset about the nature of the article “It's almost as if the article was timed to give maximum impact on everyone including the process” he said “It could just as well have been saved for a couple of days until the trial was over and the danger was passed Instead the whole damn system has had a monkey wrench thrown into it I'm displeased about it” The burden is on the state to prove the misconduct did not impact on the final verdict Metos said “The state must meet the standard that the error was harmless beyond a reasonable doubt” he said “This does have constitutional implications a general fair trial right that is implicated A new trial is warranted and we would request that the court grant the writ that we have requested and grant Mr Hamilton a new trial" Ballif asked Metos where such a trial should be held if he ruled in Hamilton’s favor Ballif said Millard County was an unlikely site because of the difficulty of selecting an impartial jury there and Wasatch Front counties were also unlikely sites because of the media concentration there “Should we hold it in Moab?” he asked “I think through procedure not so much change of venue” Metos said “we would be able to weed out people who would be inclined to do this sort of thing” Public defender Ron Yenguich also represented Hamilton The state case was presented by Special Deputy Millard County Attorney David Thompson Peterson said Thompson was retained because he had “substantial experience with these types of cases” including arguments before the Utah Supreme Court Thompson conceded “one juror had in fact read the article and had that formation in his mind” during But he argued “it is a deliberations harmless error" It was “most unfortunate” that efforts to conduct a fair trial were undermined by juror error Thompson said but “there’s no doubt in my mind that this defendant is guilty
