Ol THE DELTA CITY SEWER SYSTEM RECITALS Ihe it Council of the City of Delta Utah (referred to herein as the "City Council") hereby recites ihe following as the basis for adopting this resolution: The Della City sewer utility funds have experienced significant increases in maintenance and operation costs since establishment ol the present rates The City Council has determined through preparation of the Delta City Fiscal Object Budget liscal that sewer the lor year utility operation and maintenance funds will thereloie incur a significant deficit daring current fiscal year unless rates for sewer use are increased B The City Council has heretofore established and desires to confirm a policy that sewer charges to the extent possible should be structured such that each user or class ol users of the sewer system are required to pay an equitable amount for the benefits received by them based on the cost of operation maintenance and depreciation of the sewer systems C The City Council has determined through records and other information made available to it by the City sewer department that certain adjustments should be made to sewei system user tees to provide for more equitable license or a license to permit consumption of liquor on business premises issued under this chapter to allow any penons under Ihe age of 21 years who has consumed or is consuming beer or any other alcoholic beverage to be in or remain on any for which such licensee has premises ivsued been a license under this chapter It shall be a defense to prosecution under this subsection that Ihe licensee or his agents detained a person under the age of 21 years who had consumed beer or other alcoholic on Ihe licensed premises beverage solely for the purpose of holding Ihe person so detained until the Council of the City of Della I tilt teleircd to in this ordinance as the "Cits Council" hereby recites the follow mi as the basis for enacting this ordinance: Della City has power to regulate the sale ol light beer within the corporate bounD daries ol Delta City under Section Utah Code Annotated (1953) as amended The City B Council has preciously and hereby declares a public policy of picveming improper sales to and consumption of alcoholic beverages by persons under the age of 21 years The City Council has previously C to reduce adopted ordinances designed of alcoholic beverages to persons availability under the age of 21 years by prohibiting stiles of beer and consumption of other alcoholic in certain business establishments beverages providing entertainment to persons under the age of 21 years D The City Council has lound the criiena used to classify entertainment previously establishments and to distinguish which types should be licensed to sell beer or allow consumption of alcoholic beverages were unreliable and did not necessarily complish the desired public purpose of preventing sales to or consumption of beer by persons under the age of 21 years E The City Council established a special committee to review the existing ordinances of Delta City and to recommend more appropriate methods to effectuate the policy of preventing sales of alcohol to minors Said committee has made its recommendations to the City Council by participation of a majority of the City Council members in the committee proceedings and by a report of the committee chairman to the City Council F Based on the report of the special committee and the deliberations of the City Council the City Council has determined to amend the present City ordinances relating to alcoholic beverages and businesses providing entertainment to persons under the age of 21 years as set out in this ordinance in order to further protect the health safety and general welfare of the residents of Delta City NOW THEREFORE BE IT ORDAINED by the City Council of the City of Delta litah: Sections Ordinances Repealed M and of the Revised Ordinances of Delta City (1981 edition) as are amended hereby repealed 2 Regulations of Businesses Selling Beer or Licensed for Consumption of Alcoholic The following provisions are Beverages in their entirety as Sections hereby adopted P and N M Q of the Revised Ordinances of Delta City (1981 edition) as amended: M II shall be unlawful for any person licensed under this to allow any person chapter under Ihe age of 21 years to purchase or consume any
