THE PRESENT SECTIONS AND A AND ADOPTION OF A REVISED SECTION BY ADOPTION OF SECTION TO PROVIDE FOR STORAGE OF ABANDONED VEHICLES ON PRIVATE PROPERTY AMENDING SECTION TO PROVIDE FOR ADOPTION OF THE UTAH TRAFFIC CODE 1983 EDITION AND PROVIDING AN EFFECTIVE DATE FOR SAID AMENDMENTS RECITALS The City Council of the City of Delta Utah referred to in this ordinance as the Council" hereby recites the follow"City ing as the basis for adopting this ordinance: A The City Council finds that law forcements and zoning enforcement officers of Delta city have encouraged problems with abandonment of motor vehicles on public rights of way within Delta City and abandonment of such vehicles on property belonging to persons other than the owner of the vehicle and with accumulation of discarded junked or inoperable motor vehicles equipment and scrap metal on private property The Council further finds officers have found the that law enforcement current ordinances to be insufficient in dressing these problems B The City Council further finds that abandoned or junked automobiles motor vehicles equipment and scrap metal stored in inappropriate facilities constitute a danger to the public health safety and of the City of Delta in that they create a breeding place or habitation for insects and rodents that they resent a hazard to cupants of property especially children and that they are unsightly and detract from the of the residents of Delta and from the overall appearance of the community and from the value of property C The City Council finds that it is in the best interest of the residents of the City of Delta to adopt the most recent edition of the Utah Traffic code by formal adoption rather than by the reference set out in Section A of the Revised Oidinances of as amended Delta City (1981) NOW THERFORE BE IT ORDAINED by the City Council of the City of Delta UTah: Section Repeal of Existing Ordinances Section entitled "Definition of A entitled Nuisance" and Section exterior appearance of the automobile or render the automobile inoperable or unlawful for use on The definition shall public highways not apply to such automobiles as may K fully enclosed within a permanent structure or to removal of euqipment or parts incident to repair or restoration of such automobiles if the duration of the fully or partially stripped condition does not exceed 72 hours The unlawful for any person to abandon an automobile or other motor vehicle upon private property without the express or plied consent of the owner or person in lawful control of said property For the purposes of this section a motor vehicle shall be presumed to be abandoned if it is left unattended on private property without the press or implied consent of the owner or person in lawful possession or control of the property for a period in excess of (24) hours If the owner or person in lawful or control of property has possession reasonable grounds to believe that a vehicle has been abandoned such person may report the same to the police department Upon receiving such a report the police department shall proceed as set out in Section 1610 of the Utah Traffic Code as adopted under section A
