March 5 in Salt Lake City IPA which manages the Intermoun-taPower Plant north of Delta challenged ts tax liability and penalties during proceedings “held behind closed doors" according to Utah Association of Counties attorney Bill Peters representing Millard County in the case Peters said the initial amount was determined by an audit conducted by the commission’s sales and use tax audit division on the equipment and material installed at IPP He said the county was informed it could not intervene m the proceeding six months after the commission decided to lower IPA’s sales tax liability The county appealed to the Utah Supreme Court Peters said that a year later when the county learned a compromise had already been reached a second appeal was filed The second appeal asked that the county be allowed to intervene “We want standing to be heard” Peters said “Particularly when our taxes are being compromised" IPP accounts for 85 percent of the county's tax base State sales ux is 6 percent in most counties About percent goes to local governments and the state keeps the rest IPA attorney Mark Buchi said the lower figure was an adjustment not the result of a compromise and settlement He said the disparity was identified m part by millions of dollars that had ready been paid or credit for taxes paid by third parties Buchi said the county did not have standing in the case a little picture I ran off a calendar on a copy machine" he said “I just made it there from scratch I always wanted a train I can't afford to go buy one so I made my own " Terry started building the putting them in a comer I'll just let them have it " But you still have time to see the display “I figure I'll leave it up until they start bringing the servicemen back home” Terry said “I go through comment on a proposal to transfer money from the city’s electric utility fund to an economic development fund where it could be loaned to the company for capital About 80 people attended the meeting A show of hands at the end of the meeting showed overwhelming support for the plan The council unanimously approved setting Tuesday March 2 to formally transfer the funds The municipal utility has been worried about the same thing” DNI and Caldwell have both been checked out thoroughly Councilwoman Arlene Bartholomew said she even asked the Sheriff s Department to check Caldwell’s background on behalf of the Fillmore Chamber of Commerce In addition to a clean police record it was also pointed out that Caldwell is preparing to quit a $ 20000 a year job m California’s Silicon Valley to move to Fillmore to manage his company Attorney Warren Peterson has been retained to protect the city's interests and prepare the needed contracts A deal could be struck “withm the next few weeks" Peterson
