AMENDING THE MILLARD COUNTY ZONING ORDINANCE BY REPEAL OF THE STATEMENT OF PURPOSE AND REGULATIONS GOVERNING THE HEAVY INDUSTRIAL DISTRICT AND BY ADOPTION OF NEW PROVISIONS PROVIDING A STATEMENT OF PURPOSE AND REGULATIONS FOR SAID DISTRICT AND ADOPTING ADDITIONAL STANDARD LAND USE CODES IN THE MILLARD COUNTY STANDARD LAND USE CODE WHEREAS the Board of County Commissioners of Millard County Utah (referred to herein as the "County Commission”) has determined that the health safety and general welfare of the inhabitants of Millard County will be promoted by adopting certain amendments to the Millard County Zoning Ordinance the County Commission now recites the following as the basis for adopting the ordinance set out below: A The County Commission has received recommendations from the Millard County Planning Commission in the form of an amended Master Plan (known as the "Comprehensive Development Plan") regarding goals and policies and future plans for land use classifications and regulations in Millard County Utah B The County Commission has also received the recommendation of the Millard County Planning Commission regarding proposed amendments to the Heavy dustrial Zone and recommendation for adoption of additional land use codes C The Millard County Commission has conducted a public hearing after proper notice to consider the zoning amendments set out below The public hearing was held March — 1988 The County Commission finds that industrial land uses promote ) resource utilization and tax base but require careful analysis and review to avoid various nuisances and adverse impacts resulting from such intensive uses Therefore the County Commission finds that proper review and permitting procedures should be established for all proposed heavy industrial uses E The Comprehensive Plan Development amendments adopted by the Planning Commission and the Planning Commission recommendations regarding this ordinance mandate that all heavy industrial uses be conditional uses and that the Heavy dustrial Zone be made dependent on siting and environmental considerations F The land use code amendments recommended by the Planning Commission provide land use classifications necessary to allow industries handling hazardous waste materials and other industrial byproducts and provision should be made in the Millard County Zoning Ordinance for such uses NOW THEREFORE THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF MILLARD UTAH ORDAINS AS FOLLOWS: Section Repeal of Existing Heavy dustrial Zone Regulations The Heavy dustrial Zone regulations contained in the Millard County ordinance set out in that section of the ordinance entitled "Heavy Industrial" are hereby repealed in their entirety Section 2 Heavy Industrial Regulations Adopted The provisions
