constitution OF THE STATE OF UTAH ING TO THE PROCEEDS OF LANDS AND OTHER PROPERTY AND CREATING A PERMANENT FUND AND A UNIFORM SCHOOL FUND FOR THE COMMON AND PUBLIC SCHOOLS be it resolved by the legislature of the state of utah two thirds of all the members elected to each house concurring therein SECTION 1 that it Is proposed to amend section 3 of article 10 of the constitute on of the state of utah as a amended in e eded by the vote of the electors elector 5 at the general election of 1930 to read ai as follows sec see 3 the proceeds of the sales of all lands that have been or may hereafter be granted by the united states to th a state for the support of the common schools and five per centura of the net proceeds of the sales of united states public lands I 1 lying ing within the state and sold by the gaited united states state subsequent to the ad mission of this state into the union shall be b and remain a permanent fund to be called the state school fund the interest of wh ch only shall be expended for the support of the corn com mon schools the interest on the state school fund the proceeds of all prop arty that may accrue to the state by eichect or forfeiture all uncia mid med shares and dividends ef of any corpora tion incorporated under the laws of this state the proceeds of the sales of timber and the proceeds of the sal sale or other disposition of minerals or other property from school and state tt lands other than those granted for specific purposes shall with such other revenues as the legislature may from time to time allot thereto con statute a fund to be known as the uniform school fund which uniform school fund shall be maintained and used for the support of the common and public schools of the state and apportioned Ain in such manner as the action shall provide the pro ro visions of section 7 article XIII of this constitute on shall be construed as a limitation on the rate of taxa tion on tangible property for district school purposes and not on the amount of funds available and fur ther no moneys allocated to the un form school fund shall be considered in fixing the rates of taxation sped fled in section 7 of article XIII SECTION 2 the secretary of state Is di directed rooted to submit this proposed amendment to the electors of the state at the next general election in the manner provided by law SECTION 3 distributed among the school d str acts accord ng to the last preceding school census and in addit addia on an equal equa bation fund chich when added to other revenues provided for th s purpose by the legis lature shall be 5 for each person of school age as shown by the last pre ceding school census said equal zat on fund shall be a apportioned portioned to the school d in suet such manner as the legis lature shall provide sa d rates shall not be increased unless a proposition to increase the same spec tying the rate or rates proposed and the time during which the same shall be levied be first submitted to a vote of such of the qualified electors of the state as in the year next preceding such election shall have paid a property tax assessed to them within the state and the majority of those voting thereon shall vote in favor thereof in such manner as may be provided by law SECTION 2 the secretary of state is directed to submit this proposed amendment to the th electors of the state in the next general election in the manner provided by law SECTION 3 it if adopted by the electors of the state this amendment shall take effect the th first day of f january 1939 constitutional
