NOTICE is further given that in accordance with provisions of Statute 19-4-7, Utah Code Annotated, Annota-ted, 1953, the Board of County Commissioners will fill such vacancy va-cancy by appointment at their regular meeting on May 1, 19C8. ORDINANCE NO. 76 AN ORDINANCE PROVIDING FOR THE MANAGEMENT, CONTROL, CON-TROL, CAPTURE AND HARVEST OF WILD HORSES, OTHERWISE CALLED MUSTANGS ON THE LANDS IN THE UNINCORPORATED TERRITORY OF MILLARD COUNTY, STATE OF UTAH. THE BOARD OF COUNTY COMMISSIONERS OF MILLARD COUNTY, UTAH, ORDAINS AS FOLLOWS: Section 1. There is hereby created o committee com-mittee known as the Millard County Organization for the control con-trol and management of wild horses, otherwise known as mustangs, mus-tangs, and the committee shall act as advisory committee to the County Commission and shall be composed of a representative of the following organizations: One each from the Riding Club from the East and West area of Millard County, District Office of the Bureau of Land Management, The Wild Life Association, The Livestock Live-stock Industry of the County, County Recreational and Development Develop-ment Committee, a Citizen at Large. The membership of said committee shall be appointed by the Board of County Commissioners Commission-ers of Millard County and shall be appointed from persons properly representing one or more of the groups hereinabove listed. Section 2." It is provided that in the year rang 9 1968 members of said committee shall draw lots and three 13) committee com-mittee members shall serve for a term of two (2) years and four (4) of such committeemen shall serve for a period of three (3) years; thereafter, at the expiration of the term of the member all members mem-bers of the committee shall be appointed ap-pointed for a term of two (2) years. Section 3. The underlying purpose and intent in-tent of this Ordinance is to control, manage, regulate the wild horse population within the unincorporated unincorpor-ated areas of Millard County, Utah. Section 4. DEFINITIONS. a. Wild Horse, otherwise known as Mustang, Any horse roaming free and uncontrolled, unbranded and unclaimed. b. Mustanging. Engaging in chasing or pursuing mustangs for purpose of capture or harvesting or any acts which constitute the manipulating of the travel of mustangs mus-tangs designed to enable others to capture said mustang. c. Trap. Any corral, fence, enclosure en-closure or any barricade erected or constructed which is or may be used to stop, hold or separate or any device designed to ensnare or hold mustangs. Section 5. The mustang season is hereby created and declared established from the first day of August to and including the last day of December of each year. j Section 6. All mustanging, chasing and pursuing of mustangs is prohibited from the first day of January to the last day of July of each year. Section 7. During the mustanging season no mustang, filly or mare or any mustang colt under a yearling can be captured or taken from the desert. Section 8. No motor vehicle, airplane or any tranquilizing apparatus or trap may be used to capture or assist in capturing any mustang, unless under the direction and written permission of the County Commission. Commis-sion. Section 9. No mustang captured or harvested harvest-ed shall be used for any type of food, either for fish, animals or otherwise. Any mustang caught that is undesirable for harvest is required to be released forthwith or delivered within 24 hours to Millard County Sheriff. Section 10. The vegetation, water facilities and range management being largely controlled by the U.S. In-terior In-terior Department, it is declared that any attempt to interfere with, injure or destroy improvements, facilities, water or feeding supplies, shall be deemed improper and illegal mustanging procedure and shall be subject to punishment as hereinafter provided. Section 11. a. It is unlawful to wantonly kill, injure or maim any mustang. b. Any mustang found to be Injured In-jured or maimed should be reported report-ed forthwith to the committee for proper disposal by the sheriff. Section 12. Violation of any of the provisions of this Ordinance shall constitute a misdemeanor and the violators are subject to a fine not to exceed $299.00 andor by imprisonment in the county jail for not to exceed six (6) months. Section 13. Effective Date. This Ordinance shall take effect upon Its publication as required by law. They have all hung their heads. Mr. and Mrs. G. O. Billings received re-ceived word of the arrival of their 34th grandchild, a daughter born April 2nd to Lt. and Mrs. Bryce G. Billings of Corpus Christi, Texas. The little miss has two older sisters and a brother. Mr. and Mrs. Martin Ludwig entertained en-tertained at a birthday dinner for Martin's father on Saturday, April 13th. Attending were Mr. and Mrs. Otto Ludwig of Spring City, Mr. and Mrs. Hurbert Ludwig of Sandy; Mr. and Mrs. Kent Strate, Salt Lake; Mr. and Mrs. John D. Smith, Copperton; Mr. and Mrs. Verlin Haws of Salt Lake. Mr. and Mrs. Ken Booth and family of Salt Lake spent Easter in Delta with Mr. and Mrs. Orvil Turner and members of the Booth families. Mrs. LaVee Turner attended funeral services Monday, April 15th in Richfield for her sister, Mrs. Ruby Stewart. Mr. and Mrs. Leo McClellan and son, Byrl, of Midvale visited their uncle, Mr. Wilford McClellan Sunday Sun-day and other members of the McClellan family. Mr. and Mrs. Paul Carter and girls spent Tuesday and Wednesday Wednes-day visiting with Mr. and Mrs. Al Willden and families. Mrs. Dewey Bennett and three children of Orem visited Mr. and Mrs. Neil Forster Sunday. Visiting t the home of Mr. and Mrs. Clinton Tolbert this past week was Mr, and Mrs. Bill Brown and baby daighter, Shannon and Danny Sorensen, the young son of Mrs. LaRhue Sorensen of Salt Lake; Mr. and Mrs. Stanley Tolbert and three children, Kevin, Tracy and Troy of Sandy; Mr. and Mrs Deloy Tolbert and three children of Kingman, Ariz. Deloy and family are moving from Kingman back to Salt Lake. Mr. and Mrs. Scott Anderson and two children of West Jordan spent Easter with the Alfred Lake and Nels Anderson families. Also visiting the Lakes was their daughter, Mrs. Ron (Susan) Peterson Peter-son and baby. Mr. and Mrs. Kenny Lake and three children vacationed at Lake Powell Easter weekend. Mr. and Mrs. Evan Christensen are vacationing in Calif, with their children, Winston, Mary Jo, and Craig, and other members of the family. Mr. and Mrs. Dell Ross are great-grandparents great-grandparents again. A new son was born April 12 in Old Mexico to Mr. and Mrs. Frank Oliver. The young man is the fifth great-grandchild for Mr. and Mrs. Ross. |
