Third District Court Judge David Dee dismissed a complaint by developers John Call and Clark Jenkins against the city of West Jordan on April 5 and ruled the decision handed down in January would stand because the city did not act unreasonably when assessing a flood control impact against the developers in 1977. The suit was prompted by a city ordinance enacted in 1975 which requires developers to Ambassador Esteban Arpad Takacs from Argentina; Ambassador William J. Middendorf II, U.S. Ambassador to the Organization of American States; and Pearl Bailey, former United Nations Goodwill Ambassador. The Classroom provides the impetus for students to develop their own opinions on issues of concern by exposing them to the divergent views of the people who comprise the political leadership in Washington, D.C. A suit was filed in 1978 which 4200 W., appealed to the Supreme Court which also upheld the constitutionality of the ordinance but required that developers be given the opportunity to present evidence showing the dedication required of them had no relationship to needs for flood control or parks and recreation facilities created by their subdivision. In January Judge Dee ruled the developers failed to sustain the burden of proof showing the fee was unreasonable and the case should not be certified for class action.
