Show Mossongor-EnUrprls- Thursday, Novambar 26, 1987 o, Fog 5 Manti City makes offer to settle lawsuit out of court The Manti City Council made an offer to settle damages out of court with John Call Engineering. The City instructed Attorney Paul Frischknecht to make an offer of $3,000 to settle the claim made when Call Engineering sued the city for lost profits on engineering work done on the Manti sewer system by Call. The City cancelled Calls contract and hired another engineer to design the project. Call Engineering sued the city for breach of contract. The Sixth Judicial District Court ruled in favor of the City, whereupon Call appealed the ruling to the Utah Supreme Court. The Utah Supreme Court overturned Judge Don Tibbs ruling and remanded the case back to the District Court for a determination of damages. It's really difficult to assess what our culpability will be in this matter, commented Attorney Frischknecht. It may be appropriate to make an offer and attempt to settle the matter without further legal expense, he advised. Councilman Galen Christiansen reported on a meeting he had attended in Las Vegas as the UMPA president. He noted that a Resolution had been proposed to oppose doing away with tax exempt bonding for municipalities who would be purchasing utilities. He moved the adoption of the Resolution by Manti City. All councilmen voted aye and the Resolution was adopted. Councilman Lee J. It was reported that the price of such land varied from $3000 to $8000 per acre and that the railroad would not consider an offer of less than 60 of the appraised value. Attorney Frischknecht reported that as instructed he was preparing a Notice of Claim or Notice of Interest which could be filed with the County Recorder on non payment of water or sewer connections or other utility fees. Councilman Jim Petersen re- - other Council action: City Power Superintendent Gene Rogers reviewed various suggestions to cut the demand peak which Manti City incurs. Supt. Rogers presented, in general format, certain energy conservation techniques that could be used to allow for more efficient use of electrical energy. Possibilities involve timed control to power users (at a reduced rate) to shave the peak load and distribute the usage more evenly. Rogers was instructed to proceed with more investigations and make some concrete proposals.
