I Now, therefore, notice is hereby I given that on Saturday tho 2nd duy of September, 1916, a special election will be held within the city limits of said Logan City, Cache County, State of Utah, for the purposo of submitting submit-ting to such qualified electors of xald city as shall have paid a property tax therein in the year precodtng such election, tho following propositions, to wit: Shall bonds of Logan City, Cacho County, State of Utah, in the sum of seventy thousand dollars (170,000.00) payable in not to exceed twenty years from the date of their Issue, bearing Interest at tho rate of not to exceed five per cent per annum, Interest payable pay-able semi-annually, be issued and sold for the purpose of raising funds tor Increasing, improving, enlarging, extending, ex-tending, perfecting and adding to the present water supply and water works Bystem in said Lognn City; said water wa-ter works system and supply are and shall be owntd and controlled by said municipality. SENATE JOINT RESOLUTION NUMBER EIGHT Proposing nn amendment to Article 13 of tho Constitution of tho Stato of Utah, relating to revenue and tax ntlon. Bo It resolved 'by tho Legislature of tho Stato of Utah, two-thirds ot all members elected to each of the two houses concurring therein: Section l. It Is proposed to amend Articlo 13 of tho Constitution of tho Stato of Utah, so that tho samo will read as follows: 1 Tho powor of taxation shall never nev-er bo surrendered, suspended, or contracted con-tracted away. All taxes shall bo uni form upon tho same class of property proper-ty within tho territorial limits of the nuthorlty levying tho tax, and shall bo levied and collected for public pur poses only 2. The Legit laturo shall provido by law for tin annual tax ouincleut, with other soutces of revenue, to defruy tho estimated ordinary expenses ot tho Stato for each fiscal yeai . For the purposo of paying tho Stato debt If any there bo, tho Legislature shall provide for levying a tax annually, sufficient to pay the annual lnterost and principal of such debt, within twenty years from tho final passage of the law creating tho debt. 3. There shall be exempt from taxation tax-ation property of tho Unltod States, of tho State, counties, cities, towns, school districts, municipal corporations corpora-tions and public libraries lots with the buildings thereon used exclusively exclusive-ly for either religious worship or charitable purposes, nnd places of burial not held or used for prlvato cr corporate benefit. Ditches, canals, reservoirs, pipes and Humes owned and used by Individuals Indi-viduals or corporations for Irrigating Irrigat-ing lands owned by such Individuals or corporations, or tho Individual members thereof, shall not bo separately separ-ately taxed so long ns they shall bo owned and used exclusively for such purposo; provided, that mortgages upon real and personal property shall bo exempt from taxation; and that the taxofl of the Indigent poor may bo romttted or abated at such time and In such manner as may bo provided pro-vided by law. 4. Tho Legislature shall not Impose Im-pose taxes for tho purpose of any county, city, town or other municipal municip-al corporation, but may, by law, vest In the corporato authorities thereof, respectively, tho power to assess and collect taxes for all purposes of such corporation. 5. The surfaco ground of all mines and mining claims, both placer and rock In place, containing or bearing gold, silver, copper, lead, Iron or oth-or oth-or valuablo metals after purchase thereof from the United States, shall bo taxed at a value not greater than the prlco paid tho United States therefor, unless tho surface ground or some part thoreof, of such mine or claim, is used for other thun mlti Ing purposes, and has a separate and Independent valuo for such offer purposes; In which case said surface ground, or any part thoreof, ho used for other than mining purposes, shall be taxed at Us- value for such other purposes ns provided by law; and all machinery- used In mining and all property and surface Improvements upon or nppurtennnt to mines and mining claims, which havo r valuo separate and Independent of such mines or mining claims, shall be taxed as provided by law. All lands containing coal, granite, stone, marble, mar-ble, onyx, gas oil hydro carbons, gypsum gyp-sum or other valuable mineral deposits de-posits other than those enumerated above In this section, after purchase thereof from the United States and all property and surfaco Improvements Improve-ments upon or appurtenant to such lands which havo a value scparato and Independent of all such lands shall bo taxed as provided by law. In addition to tho assessment ot the surfaco grounds, improvemonta and machinery ot mines and mining claims, all mines and mining claims producing net proceeds shall be taed at a value not to exceed three times such net proceeds. 6. An accurate statement of the receipts re-ceipts und expenditures of the public moneys shall bo published annuaVj' In such manner as the Legislature may provide. 7. Tho rato of taxation on property fjr State purposes shall never exceed eight mills on each dollar of valuation valua-tion to bo apportioned as follows: Not to exceed four and ono half mills on each dollar of valuation for gen-oral gen-oral Stato purposes; not to exceed three mills on each dollar of valuation valua-tion for district school purposes; not to oxceed cno halt mill on each dollar dol-lar of valuation tor high school purposes; pur-poses; tint part of tho Stato tax apportioned ap-portioned to high school purposes shall constltuto a fund to bo railed tho "high school fund" and Bhall bo apportioned to tho cities and school district maintaining high schools In tho manner tho Legislature may provide. pro-vide. An J whenever tho taxable property within the Stato shall amount to Four Hundred Million Dollars, Dol-lars, tho rate shall not oxceed five mills on each dollar of valuation; unless un-less a proposition to Increaso such rate, specifying thd rato proposed and tho time during which tho samo shall bo levied, bo first submitted to a vote of such of the qualified electors of tho Stato ns, In tho year next proceeding pro-ceeding such election, shall havo paid a property tax assessed to themwllli-In themwllli-In the State, and the majority of those voting thereon shall vote In favor fa-vor thereof, In such manner as may bo provided by law. 8. Tho making of profit out ot public moneys, using the some for any purposo not authorized by law, by any public officer, shall bo deem ed a felony, nnd shall bo punished as provldod by law, but part of such punishment shall bo disqualification to hold public olllco. 9. No appropriation shall bo made or nny expenditure authorized by tho Legislature, whereby tho expenditures expendi-tures of tho Stnto, during any fiscal year, shall exceed the total lax then provided for by law, and nppllcablo for such appropriation or expenditure, expendi-ture, unless tho Legislature making such appropriation, shall provido for levying a sufficient tax, not exceeding tho rates allowed In Sectki 0 of this nrtlcle. to pay such appropriation or expenditure within such fiscal year This provision shall not apply to appropriations ap-propriations or expenditures to suppress sup-press Insurrections, defend tho Stato, or assist In defending tho United States In time of war. 10. Nothing In this constitution shall bo construed to prevent the Legislature Leg-islature from providing a stamp tax, or a tax based on Income, occupation licenses or franchises. Section 2. Tho Secretary of State Is hereby ordered to give this propo sltlon to be published In at least one newspaper In ovory county In the State where a newspaper Is printed and published for two months preceding pre-ceding the next general election. Section 3. This proposition shall bo submitted to the electors o this State at tho noxt general election for their approval or disapproval.
