Show RESOLUTION Proposing an Amendment to Section 3, Article XI, of the Constitution Relating to Counties, Cities and Towns, For the Purpose of Prescribing Prescrib-ing Manner of Creating New Counties And Changing Chang-ing Boundaries. Do it Resolved nnd Enacted by tho Legislature of the State of Utah, Two-Thirds of the Members Mem-bers Thereof Concurring Therein : Section 1. That the following proposition to amend the Constitution Consti-tution of tho State of Utah is hereby submitted to the qualified electors of the State for their approval ap-proval or disapproval, namely: That Section 4, Article 13 of the Constitution of Utah be, and the same is hereby amended to read as follows: Section 4. All mines and mining min-ing claims, both placer and rock in place, containing or bearing Gold, Silver, Copper, Lead, Coal or other Valuable mineral deposits, depos-its, nftcr purchase thereof from tho United States, shall be taxed at the price paid the United States therefor, unless the surface sur-face ground, or some part thereof, there-of, of such mine or claim, is used for otlier than mining purposes, and has a separate and independent independ-ent value for such other purposes; purpos-es; in which case said surfece ground, or any part thereof, so used for other than mining purposes, pur-poses, shall be taxed at its value for such other purposes as provided by law: and all the mnchhicry used in mining, and all property and surface im provements upon or appurtenant to mines and . mining claims, which have a value separate ancf independent of all such mines or mining claims, and the net annual proceeds of all mines nnd mining claims, shall bo taxed by the State Board of Equalization. Section 2. The Secretary ' of State is hereby ordered to give this proposition to be published in at least one newspaper in every ev-ery County of the State where a newspaper is printed and published publish-ed for two months preceding the next general election. Section 3. This proposition shall be submitted to the electors of this State at the next general election for their approval, or disapproval: All official ballots used at such election shall have printed or written thereon tho words: "For the amendment of Section 4, Article 13, of the Constitution, Con-stitution, relating to the taxation of mines." The Legislature shall have power to enact laws creating new counties out of territory, ter-ritory, taken from one or more of the existing counties of this State, and defining the duties and obligations of any such new county, coun-ty, as between itself and any county from which territory is taken in its creation." Also to enact laws changing the boundaries boundar-ies of any county. Section 2. The Secretary of State is hereby, ordered to cause this proposition to be published in at least one newspaper in every ev-ery county of the State where a newspaper is published, for two months immediately preceding the next general election. Section 3. TINGEY, Secretary of State. t A RESOLUTION Proposing, nn Amendment to Section Sec-tion 7 of Article XIII of the Constitution of the State of Utah, Relating to the Rate of Taxation. Bo it Resolved and Enacted by the Legislature of the State of Utah: Section 1. That it is proposed to amend Section 7 of Articlo XIII of the' Constitution of the Stato, of Utahso that the same will read as follows: 7. Tho rate of State taxtion on property for State purposes purpos-es shall never exceed eight mills on each dollar of valuation ; four and one hnlf mills on each dollar of valuation for general state purposes; three mills on each dollar of valuation for district school purposes; one half mill on each dollar of valuation for" high school purposes; and whenever tho taxable property within the State shall' amount to Pour Hundred Hun-dred Million Dollars, the rate shall never thereafter exceed five mills on each dollar of valuation ; unless a proposition to increase such rate, specifying the rate proposed pro-posed and the time during which the same shall be levied, be first submitted to a vote of such qualified quali-fied electors as shall have paid a property Jax assessed to them within the State in the year next preceding such election nnd the majority of those voting thereon shall vote in favor thereof in such manner as may be provided by lnw Section 2. The Secretnry of State is directed to submit this proposed amendment to the electors elec-tors of the Stnte at the next gen-ral gen-ral election, in the manner provided pro-vided by law,. Section 3.
