The property Includes the Dig Casino saloon and dhnca hall and the Green Goose resort at Tonopah; Tono-pah; 27,480 shares of stock In tne Nice County Land and Livestock com pany, held by th,o Tonopah Danklng corporation, and several thousand dollars In money and JewciB. i Mrs. Johnson seeks to have set I aside a divorce decree which was granted In Tonopah December 14 1D09 she now alleges, by fraud upon herself her-self and the court, and fine Beeks h redistribution 'of the property. Mrs. Johnson was oblldged to appeal to tho federal courts because the statute of limitations is in operation where the d strict court Is concerned. She allege that sho was induced to Blgn an agreement through deception decep-tion and fraud by which she consented consent-ed that Johnson secure a divorce upon up-on giving her his note for $30,000 and paying her $75 monthly. She alleges that she was Induced to sign an appearance In the case before the action had been filed. The appearance appear-ance waived notice,. It is charged that while she walled for her hua-band's hua-band's return in the office ot his attorney at-torney the complaint was file and the decree gTanted within an hour. The divorce was secured on grounds of abandonment and Mrs. Johnson asserts it was procured upon false testimony. She and Johnson had 1 ved together three days previously. Nothing was said as to a minor son now 17 years old and at school in Los Angele"s. Johnson is said to have represented to tho court that ho was in poor clr- Icumstnnces, whereas ho was wealthy.
