Findlay Herald Journal Staff Writer HYRUM — To overcome yet another obstacle which has stepped between them and a $11 million loan to fund the city's sewer project the Hyrum City Council Wednesday called a special bond election Mayor Reece Nielsen told the council that Hyrum citizens must be willing to approve the issuance of the bonds or the city will not be aide to obtain a loan from the Farmers Home Administration needed to fund the city's share of the sewer system's cost The council also discussed with an attorney for Richard Nielsen its reasons for refusing to grant Nielsen two building permits learned the city had barely missed getting approval of $362000 in Housing and Urban Development funds and refused to grant a business license for a neighborhood barber shop The date for the special bond election was set for April 6 Voitrs will be asked to approve the issuance of $1250000 in revenue bonds and-o- r the same amount in general obligation bonds A public meeting to explain the necessity of the bonds was tentatively set for March 25 7:30 pm in the Hyrum LDS Stake Center The ballot question which must be answered by the voters will be confusing Mayor Nielsen conceded because it will ask for approval or dissapproval of two types of bonds Explaining the need to place both revenue and general obligation bonds before the Nielsen said the city public would prefer to use revenue bonds as the basis for getting the FmllA loan but may be prevented from doing so by a federal-stat- e clash over loan regulations There is a conflict in the language between federal loan regulations and state regulations as a result of recent changes in Utah's Municipal Bonding Act he said and a pending lawsuit challenging the Utah act And until the issue is resolved the FmHA will not approve a loan based on revenue bonds in Utah but will approve a loan based on general obligation bonds He would prefer revenue bonds Nielsen said because they would obligate only that revenue voters to approve both types of bonds: Revenue bonds in the clash may hope the federal-stat- e be soon resolved and such bonds can be used and general obligation bonds in case the clash is not resolved It appears the mayor said that the clash will not be resolved soon and the only way the city can obtain the swjt loan will be to iaMjP gner al obligation bonds it maj (v confusing to the vnr However he explained a general obligation bond would give the city's creditors claim to all of the city's funds in the evert not enough revenue was coming from the sewer to pay off the obligation So he said the city will ask to both type of bonds Asked if the whole sewe project would be lust should voters refuse to authorize the bonds Nielsen responded it would only be a temporary setback but a costly one He is certain he said that federal clean water laws will require the city the build a sewer system If the bond issuance was refused the city would have to start ovr again and take the
