Farmington, for one of two men charged with robbery of a Layton drug store last April during which Five hostages were held captive for more than 12 hours. TRIAL WAS set by District Judge J. Duffy Palmer after denying a motion by Davis County Public Defender Loren D. Martin to have five counts of kidnapping reduced to a single charge. The defendant, Samuel James Jr., 32, is also charged with one count of aggravated robbery. ATTY. MARTIN argued in a pretrial hearing last week that it would be double jeopardy for the defendant to be charged with five counts of aggravated kidnapping. This is a single act, said Atty. Martin. It just so happened that five persons were involved. My client shouldnt be charged with a separate count for each individual in- volved.. POLICE RECORDS show that as many as eight persons were actually held hostage during the alleged robbery, but that three of them were released after a few hours. The remaining five were held hostage for more than 12 hours. Atty. Martin argued that to file multiple charges of kidnapping was double jeopardy. He also cited several court cases in which courts had ruled that multiple charges can not be filed against a person just more than one person is present when a criminal act is committed. HOWEVER, Davis County S. Page argued that we are not dealing with consecutive prosecutions in this case, but several complaints have been filed because the act (of kidnapping) was carried out on each individual, not merely a group of persons. After hearing both sides of arguments, including the citing of previous court cases, Judge Palmer denied the motion by Atty. Martin. He also denied a motion by the defense attorney to have a change of venue and the case heard in another community. Attorney Rodney THE DEFENDANT and Richard D. Thomas, 26, were charged with the robbery of Kowley Drug Store, Layton, last April pleaded guildty to one count each of aggravated robbery and aggravated kidnapping. However, Judge Palmer held in abeyance the other four counts of kidnapping untill Thomas completes his present prison sentence and subse- quent parole requirements, grb |
