The case of Baker Lumber Co. vs. John H. Latimer, City Treasurer of Nephi City, and the Nephi National Bank vs John Henry Latimer. City Treasurer were tried before the Court on February 15th, and a decision entered in favor of the plaintiff in each case. T. H. Latimer, was represented by King, Nibley, This was a and Famsworth. friendly suit brought by both of the plaintiffs corporations for the purpose of testing the validity ot two certain warrants issued to the plaintiffs by Nephi City. It will be remembered that in the year 1913 Nephi City did considerable paving, and in part payment thereof it issued to Nephi National Bank a warraut for $5000.00 and it also issued a warrant in the sum of $594.50 to the Baker Lumber Company. The warrants were issued on the 3rd day of January A. D. 1914 for work done in 1913. The City Treasurer refused to either register or pay the warrants on the grounds that the revenues of one year could not be used to pay debt contracted in another year, and that the warrants were in excess of the debt limit fixed by law. If the apple'tree is moderately pruned every year, new growth and fruit spurs and continually being produced, according to Dr. Leon D. Batchelor, head of the Horticultural department of the Utah Agricultural College. If years of neglect precede the pruning, the twig growth which will follow is likely to throw the tree out of bearing. Therefore if the tree is extremely dens or if the shape is to be changed, radically, itis much better to distribute the pruning over a number of years rather than bring about such a change in a single year. The shape of the tree can be materially chanced or the neglected tree can be thinned out and considerably remedied and still keep the tree bearing if this severe pruning is distributed through a number of years.
