NOTICE OF INTENTION TO CORRECT LEGAL DESCRIPTION OF PAUNSAGAUNT CLIFFS SPECIAL SERVICE DISTRICT NOTICE IS HEREBY GIVEN THAT ON September 13, 2004, the Board of County Commissioners of Garfield County, Utah, adopted a Resolution declaring that the public health, convenience and necessity require the correction of the legal description of the Paunsaguant Cliffs Special Service District by adding to ; said District the corrected legal description of the boundaries of said District, and by deleting the incorrect description. SERVICES OF THE DISTRICT The Paunsagaunt Cliffs Special Service District has been organized to provide fire protection services, snow removal, water and sewer services serv-ices through the acquisition or construction of fire protection facilities, water and sewer facilities facil-ities with necessary appurtenances appurte-nances and equipment therefor. METHOD OF FINANCING Pursuant to the provisions of the Utah Special Service District Act, I.VB17A-2-1301 et seq., Utah Code Ann., as amended, and Article XIV, Section 8 of the Utah Constitution, the Paunsagaunt Cliffs Special Service District may annually impose fees and charges to pay for all or part of the cost of lire protection facilities, facili-ties, snow removal, water and sewer services to be provided by said District. It may also annually annu-ally levy taxes upon all taxable property within the corrected legal description of said District, to provide the proposed services, and may issue bonds for the acquisition and construction construc-tion of said facilities and services, servic-es, provided, however, that said tax levy to provide said services or to repay said bonds, must be authorized and approved by a majority of the qualified electors elec-tors of the Special Service District at an election for that purpose. PUBLIC HEARING ON PROPOSED CORRECTION OF LEGAL DESCRIPTION OF SPECIAL SERVICE DISTRICT The Board of County Commissioners of Garfield County will hold a public hearing hear-ing on the correction of the legal description of the Paunsaguant Cliffs Special Service District (a District previously established) at the Garfield County Administration Building, 55 S. Main, Panguitch, Utah, at 1:30 p.m., on Monday , the 1 1th day of October, 2004. Any interested interest-ed person may protest the addition addi-tion andor deletion of property to said District or the furnishing of services therein either orally at the hearing or in writing, at, or at any time prior to, the hearing hear-ing and within fifteen (15) days after the conclusion of the hearing. hear-ing. Where title to any property proper-ty is held in the name of more than one person, all of the persons per-sons holding title to the property proper-ty must join in the signing of the protest. At said public hearing the County Commissioners will give full consideration to all protests which shall have been filed and will hear and consider all interested persons desiring to be heard. The Commission may continue the hearing from time to time. After conclusion of the hearing, the Commission shall adopt a resolution correcting the legal description by adding the correct description, and deleting the formerly adopted, but erroneous erro-neous description of the Paunsagaunt Cliffs Special Service District or determining that the establishment of said District in the correct description descrip-tion should be abandoned, or may, in its discretion, reduce the boundaries of the proposed District and establish the corrected cor-rected boundaries, as modified. If, within fifteen (15) days after the conclusion of the hearing, hear-ing, over fifty percent (50) of the qualified voters of the territory terri-tory proposed to be included within the Special Service District, or the owners of fifty percent (50) of the taxable value of the taxable property within the proposed Special Service District, file written protests against the establishment establish-ment of the proposed District with the County Clerk, the County Commission is required by law to abandon the proposed correction of the legal description descrip-tion of said District. Any person who shall, at or any time prior to the date and time above-specified for the hearing, file a written protest with the County Clerk against the corrected legal description of the Paunsagaunt Cliffs Special Service TJistrict and wnose property has been included includ-ed within the boundaries of the proposed corrected legal description of the District notwithstanding such protest, may, within thirty (30) days after the adoption of the Resolution establishing the District, apply to the District Court of the Sixth Judicial District for a writ of review of the actions of the Board of County Commissioners in establishing the Paunsagaunt Cliffs Special Service District, only upon the grounds, however, howev-er, that his property will not be benefited by the services authorized author-ized to be furnished by said District or that the proceedings taken in the establishment of the District have not been in compliance com-pliance with law.
