Show Page 7 The Garfield County Insider July 16, 2009 LEGAL NOTICES NOTICE OF A PUBLIC HEARING FOR THE DRAFT ENVIRONMENTAL ASSESSMENT AND THE DETERMINATION OF SECTION 4(F) DE MINIMIS IMPACT FINDING SR-12, Boulder to Escalante in Garfield County, Utah Project No: STP-0012(8)60E A public hearing is being held for the SR-12, Escalante to Boulder, Environmental Assessment (EA) Project on August 6, 2009 from 5:30 – 7:30 p.m. at the Boulder Town Hall (351 North 100 East, Boulder, Utah). The Utah Department of Transportation (UDOT), in coordination with Federal Highway Administration (FHWA), herewith advises all interested persons the intent to provide right-of-way acquisition and safety improvements along SR-12 from Boulder (Mile Post [MP] 59.8) to Escalante (MP 86.3) in Garfield County, Utah. The purpose of the project is to: Provide adequate space for UDOT to perform ongoing maintenance operations on the roadway and supporting infrastructure Improve safety and infrastructure where the roadway facilities are deficient or deteriorating • Accommodate the wide range of corridor users (e.g., automobiles, bicyclists, and tourists) • The proposed improvements for this project include the following: • Construct six slow-vehicle turnouts • Improve the Hole-in-the-Rock Road and Calf Creek Recreation Area intersections by adding turn lanes • Widen the roadway at one narrow curve (MP 71) • Improve signage (e.g., bicyclists and wildlife) to reduce conflicts • Obtain right-of-way for 14.2 miles from MP 68.9 to MP 83.1 • Replace the Calf Creek Bridge • Stabilize the roadway at three locations where the barrier or embankment is unstable (which may require blasting) The public is advised a draft EA has been prepared for this project; this EA defines the scope of the project, alternatives, potential for environmental impact, and mitigation measures that might relieve potential impacts. The draft EA will be available at the following locations during regular office hours beginning July 16th through September 4th, 2009: • Anasazi State Park Museum: 460 North Highway 12, Boulder, Utah • Escalante Library: 90 North 100 West, Escalante, Utah • Salt Lake City Library: 210 East 400 South, Salt Lake City, Utah • Escalante Interagency Visitor’s Center:755 West Main, Escalante, Utah • Grand Staircase-Escalante National Monument Headquarters—Kanab:190 East Center Street, Kanab, Utah • UDOT Region 4 Headquarters:1345 South 350 West, Richfield, Utah • Calvin L. Rampton Complex:4501 South 2700 West, Salt Lake City, Utah • FHWA:2520 West 4700 South, Suite 9A, Salt Lake City, Utah • H.W Lochner:310 East 4500 South, Suite 600, Salt Lake City, Utah Approximately 20 miles of the project corridor is within the legislative bounds of the Grand Staircase-Escalante National Monument. FHWA has determined the monument is a Section 4(f) resource. The proposed project would result in approximately 350 acres of federal land transfer for highway right-of-way within the monument. Based on the impacts and measures to minimize harm, UDOT recommends—pursuant to Section 6009 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU)—the effects of the proposed project on the monument meet the impacts criteria and requirements specified in SAFETEA-LU for a de minimis impact finding. The Bureau of Land Management having jurisdiction over the monument, concurred with the de minimis impact finding for the monument. For parks, a de minimis impact is one that will not adversely affect the features, attributes, or activities qualifying the property for protection under Section 4(f). In accordance with Section 6009 of SAFETA-LU and 23 CFR 774.5, FHWA and UDOT are providing this notice to advise all interested persons or groups of their intent to issue a Section 4(f) de minimis impact finding for the monument. Comments on the draft EA and Section 4(f) de minimis impact finding will be accepted until September 4, 2009 and should be submitted to SR-12, Boulder to Escalante, c/o H.W. UPAXLP NOTICE OF PUBLIC HEARING AND BONDS TO BE ISSUED NOTICE IS HEREBY GIVEN that on July 6, 2009, the Board of Trustees of the Municipal Building Authority of Garfield County, Utah (the “Issuer”), adopted a resolution (the “Resolution”) declaring its intention to issue its Lease Revenue Bonds (the “Bonds”) pursuant to the provisions of the Utah Local Government Bonding Act, Title 11, Chapter 14, Utah Code Annotated 1953, as amended and the Utah Municipal Building Authority Act, Title 17A, Chapter 3, Part 9, Utah Code Annotated 1953, as amended (collectively, the “Act”) and to call a public hearing to receive input from the public with respect to the issuance of the Bonds and the potential economic impact on the private sector that the facility funded by the Bonds may have. TIME, PLACE AND LOCATION OF PUBLIC HEARING The Issuer shall hold a public hearing on July 27, 2009, at the hour of 10:00 a.m. The location of the public hearing is the Garfield County Commission Room, 55 South Main Street, Panguitch, Utah. The purpose of the meeting is to receive input from the public with respect to the issuance of the Bonds and any potential economic impact that the Project financed in whole or in part with the proceeds of the Bonds may have on the private sector. All members of the public are invited to attend and participate. PURPOSE FOR ISSUING BONDS The Issuer intends to issue the Bonds for the purpose of (i) financing a portion of the cost of construction, furnishing, leasing, maintaining or operating of a fire station and related facilities to be used and operated by Panguitch Lake Fire Protection District; and (ii) paying costs of issuing the Bonds. PARAMETERS OF THE BONDS The Issuer intends to issue the Bonds in the principal amount of not to exceed $500,000, to bear interest at a rate not to exceed 3.5% per annum, to mature in not to more than 30 years from their date or dates, and to be sold at a price not less than 100% of the total principal amount thereof, plus accrued interest, if any, to the date of delivery. The Bonds will specify that any installment of principal on the Bonds which shall not be paid when due shall bear interest at the rate of 18% per annum from the due date thereof until paid. The Bonds are to be issued and sold by the Issuer pursuant to said resolution of the Board of Trustees of the Authority duly adopted on July 6, 2009, and pursuant to the provisions of the Utah Municipal Building Authority Act, Chapter 3 of Title 17A of the Utah Code Annotated 1953, as amended (the “Act”), are to be issued for the purpose of defraying the cost of construction, furnishing, leasing, maintaining, or operating a fire station and related facilities to be used by Panguitch Lake Fire Protection District, and for paying all costs incident thereto and to the authorization and issuance of the Bonds. A copy of the Resolution is on file in the office of the Secretary in Panguitch, Utah, where it may be examined during regular business hours of the Secretary from 9:00 a.m. to 5:00 p.m., Monday through Friday, for a period of at least 30 days from and after date of the publication of this Notice NOTICE IS FURTHER GIVEN that pursuant to law for a period of thirty (30) days from and after the date of the publication of this notice, any person in interest shall have the right to contest the legality of the above-described Resolution of the Board of Trustees of the Authority adopted on July 6, 2009, or the Municipal Building Authority Lease Revenue Bonds authorized thereby and that after such time, no one shall have any cause of action to contest the regularity, formality or legality thereof for any cause whatsoever. UPAXLP NOTICE The Garfield County has been granted renewal of its permit to operate the Garfield County Dead Animal Class IVb Landfill located north of Panguitch, Utah. Renewal of the permit will allow the disposal of dead animals placed in designated trenches and covered immediately each time an animal is brought to the facility. Notice of the 30-day public comment period on the draft permit and application was published in the Salt Lake Tribune, Deseret News, and Garfield County Insider on May 28, 2009. No comments were received during the public comment period. The Executive Secretary of the Utah Solid and Hazardous Waste Control Board approved the permit renewal application and set an effective of June 30, 2009.
