to revenue and taxation de be it resolved by the legislature of the state of utah two thirds of all members elected to each of tit the 0 two houses concurring therein section 1 it la is proposed to amend article 13 of tile the constitution of the state of utah so that the same will read as follows I 1 the power of taxation shall never be surrendered suspended or contracted away all taxes shall be uniform upon the samo same class of property erty within tile the territorial limits of the authority levying the tax and shall bo be levied lovied and collected for public purposes only 2 TIO the 1 legislature shall provide by law for an annual tax sufficient I 1 with other boti rees of revenue t to 0 dr it I 1 fray the estimated ordinary expenses of tile the state for each fiscal year ear for the purpose of paying pacing tile tho state debt if any there be the legislature shall provide tor for levying a tax ta annually sufficient to pay the alie annual interest and principal of such bucl debt vi thill twenty years from the final passage or of law creating tho the debt 3 there shall lie bo exempt from taxation property of the united states of the state counties cities towns school districts municipal corporations and public libraries lots with the buildings thereon hereon used exclusively for either cither religious worship or purposes and places of burial not held field or used tor for private or corporate benefit ditches canals reservoirs pipes and flumes blumes owned and used by individuals or corporations for irrigating lands owned by such individuals or corporations or the individual members thereof shall not be para cly tely taxed so long as they shall a owned and used exclusively for such purpose provided that mortgages upon real and personal property shall bo be exempt from taxation and that the taxes of the indigent poor may be remitted or abated at such time and in ili such manner as may be provided by law 4 tit the legislature shall not impose taxes for the purpose of any ally county city town or other municipal corporation but may by law vest in the corporate authorities tholof respectively I 1 ively the power to assess and collect taxes for all purposes of such corporation 5 the surface ground of all mines and mining claims both placer and rock in place containing or bearing gold sliver copper lead iron or other valuable metals after purchase thereof from the united states shall bo be taxed at a value not greater than I 1 the tile the united states thero there 1 for unless tho the surface ground or somo some part thereof of such mine or claim Is used for other than mining purposes and has a separate and independent vain for such other purposes in case said surface ground or any part thereof so used tor for other than mining purposes shall 1 bo be taxed at its value tor for such other purposes posea as provided by law lav and all machinery used in ili mining and all 11 property and surface improvements upon or appurtenant appun tenant to mines and mining claims which have a value separate and independent of such mines or mining claims shall bo be tax ta ed as provided by law all lands containing coal granite stone marble on onyx gas oil hydro carbons gypsum or other valuable mineral deposits other than those enumerated above in this section after purchase thereof from tile the noted states and all property and surface improvements upon or appurtenant to ah s lands which have a value alue separate and independent of all such lands shall be taxed as provided by law in ili addition to td tile the assessment of the surface grounds improvements and ma chinery of mines and mining claims all mines files and mining claims pro ing net liet proceeds shall ho be taxed at a value not to exceed three times such net proceeds 6 an accurate statement of the receipts an and expenditures of the pull public moneys shall be published annually in such manner as the legislature may provide 7 the rate of taxation on property tor for state purposes shall never exceed eight mills on each dollar of valuation to bo be apportioned as follows not to exceed tour four and halt half mills on oil each dollar ot of valuation tor for general state purposes not to exceed three on each dollar of cd valuation for district school purposes not to exceed ono one lial hal finall on each dollar of valuation for high school purposes that part of the state tax apportioned to high school purposes shall constitute a fund to lie be called the high school fund and shall bo be apportioned to tile ho cities and se districts maintaining high schools lu III tile manner tile tho legislature may provide and whenever the taxable property within tho the state shall amount to four Il undred M million Dol dollars laia tile rate rhall not exceed live mills on oil each dollar of valuation un iiii less a proposition to increase ln creaso such rate specifying tho the rate proposed and the time during which tho salo shall ho bo levied bo be farst submitted to a voto vote of such of the qualified fled electors of the state as lit in the year oar next proceeding such election shall havo have paid a prop pi op erty tax assessed to them within tile the state and the majority of thoice voting thereon shall vote oto lit in favor thereof in ili such ni manner aliner as inny be provided by law 8 tile the making of out of public moneys using tile thu same for a any ny purpose not authorizes authorised i by law by any public officer shall bo be deemed it felony and shall bo be punished as provided by law but part of such punishment shall bo be disqualification to hold public office 0 9 no appropriation shall bo be made or an ally expenditure authorized by the whereby the 3 of thu tho state during any fiscal year yea r shall exceed the total tax then provided for foi by law and applicable for such buch appropriation or expenditure unless tile the Legisla legislature turo making such op rl ria atlon tion shall provide for ig a sufficient clent tax not exceeding rates allowed lit in section 6 of this article to pay such appropriation or expend aturo within such fiscal year tills this provision shall not apply to appropriations ilat riat lons ions or expenditures to suppress insurrections defend the state or assist lit in defending the united states tit in time of war 10 nothing in fit this constitution shall bo be construed to prevent the legislature from providing a stamp tax or a tax based on income occupation licenses or franchises sec bee 2 the secretary of state Is hereby ordered to give tills this proposition to be published lit in at least one newspaper in ili every county lit in the state where a newspaper Is printed and published for two months pieced ing the next general election see sec 3 this proposition shall be submitted lat to the electors of this state at tin the next general for their approval or disapproval all official ballots used lit such election shall I 1
