taxation be it resolved by tho the legislature of the state of utah two thirds of all members elected to each of the two houses concurring therein section 1 it la Is proposed to amend article 13 of the constitution of the state of utah so that tile tho samo same will read as follows 1 tile the power of taxation shall never be surrendered suspended or contracted away all taxes shall he be uniform upon tile the same class of property within the territorial limits of the authority levying the tax and shall be levied and collected for public purposes only 2 the legislature shall provide by law for an annual tax sufficient with other sources of revenue to detray defray the estimated ordinary expenses of the state tor for each fiscal year for the purpose of paying pas ing the state debt it if any thoro there be tho the legislature shall 1 provide tor for levying a tax annually sufficient to pay the annual interest and principal of such debt within twenty years adars front from tho the final passage of the law creating the debt 3 there shall be exempt front from taxation ta atlon property of the united states of tile the state counties cities towns school districts municipal corporations and public libraries lots with the buildings hereon used exclusively for either religious worship or purposes and places place of burial not hold held or used tor for private private or corporate benefit ditches canals reservoirs pipes and flumes blumes owned and used by indle i ituala or corporations tor for irrigating lands owned by such individuals or corporations or the individual members thereof shall not be sepa separately ratel y taxed so long as they shall be owned and used exclusively tor for such purpose pose provided that mortgages upon real and personal property shall bo be exempt from taxation and that tile tho taxes of tho the indigent poor may bo be remitted or abated at such time and in such manner as may be provided by law 4 the legislature shall not imposed posed taxes for or the purpose of any county city town or other municipal corporation but may by law vest in tho the corporate authorities cherof respectively ively the power to assess and collect taxes for or all purposes of such buell corporation 6 5 the surface ground of all mines and mining claims both placer and rock in place containing or bearing gold a copper lead iron or other metals after purchase thereof arm the united states shall be taxed at a value not greater than the arico paid tile the united states there for unless tho the surface gr ground zid or some part thereof of such budi mine or claim Is used for other than mining milling purposes and has a separate arid and independent value for such other purposes in ili which case said surface ground or any part thereof so BO used for other than mining purposes shall bo be taxed at its value for such auch other purposes as provided by law all and all 1 machinery used tit in mining arid and all property pio perty and surface improvements upon or appurtenant to mines and mining claims which have a value separate and independent of such mines or mining claims shall be taxed as provided by law all lands containing coal granite stone marble maible onyx gas oil hydrocarbons hydro carbons gypsum or other valuable mineral deposits other than those enumerated above in this section after purchase thereof from the united states and all property pio perty and surface improvements upon or appurtenant to such lands which have a adlue arid and independent of all such lands shall lo be taxed as provided by law in ili addition to the assessment of the surface grounds improvements and machinery of mines arid and mining claims all mines and mining claims producing net proceeds shall be taxed i and one half mills on oil each dollar of 0 valuation for general state purposes not to exceed three mills on oil each dollar ot of valuation atton tor for df district strict school purposes not to exceed one halt half mill on oil each dollar ot of valuation tor for high school purposes that part ot of the state tax apportioned to high school purposes shall constitute a fund to be called the high school fund and shall be apportioned to the cities and school districts maintaining high schools in the manner the legislature may provide arid and whenever tile the taxable property within tile the state shall 1 amount to four If hundred undrea milli million dollars the rate ahall not exceed five mills on oil each dollar ot of valuation unless a proposition to increase such rate specifying the rate proposed and the time during which the same shall bo levied be first submitted to a vote of such buell of the qualified electors of the state as tit in the year next proceeding such buell election shall have paid a property tax ans assessed essed to them within tile the state and the majority of those voting thereon shall vote in ili favor thereof in ili such manner as may bo be provided by law 8 the making of profit out of moneys money using the same for any purpose not authorized by law by any public officer shall bo be deemed a felo felony y and shall bo be punished as provided d by law but part of such punishment shall bo be disqualification to told hold public office a 9 no appropriation shall bo be made or any expenditure authorized by tile thu legislature whereby tho the expenditure of the state during any fiscal year shall exceed the total tax then provided for by law and applicable for lucli appropriation or expenditure unless the legislature making such appropriation ria tion shall provide tor for levying a sufficient clent tax not exceeding the rates allowed tit in section 6 of 0 this article to pay such appropriation or expenditure within such fiscal year this provision shall not apply to appropriations riat ions or expenditures to suppress insurrections defend tho the state or assist in fit defending tile the united states in time of war 10 nothing in ili tills this constitution shall be construed to prevent pi event tile the legislature front from providing a tax tac or it tax based on oil income occupation licenses or franchises sec 2 tile tho secretary of state is hereby ordered to give elvo this proposition to be in ili at least one newspaper tit n every county in fit tile tho state where a newspaper la Is printed and published for two months preceding tho the next general election see sec 3 this proposition shall la submitted to the electors doctors of this th Is state at tile the next general election tor for their approval or disapproval A all olf lelal ballots used at such buell election shall havo have printed or written thereon tho the words for tile the amendment of article 13 of tho the constitution
