Show A4 The Emery County Review, Tuesday, October 28, 2008 Sheriff’s Office responds to unusual incidents during week The Emery County Sheriff’s Office was faced with several unusual incidents this past week, including two break-ins at the same business in Orangeville and a fallen power line that killed three horses. The break-ins happened at Best Tech Auto, owned by Jason Mills. The first occurred on Oct. 23, the second on the evening of Oct. 24. After an alarm sounded, Mills contacted the sheriff’s office to respond. Mills and Officer Blake Gardner found a window on the west side of the building had been broken. According to Detective Bob Blackburn, a small amount of money was taken during the first break-in, but nothing was taken the second time because the owner had removed valuables from the store. Blackburn said they suspected the burglaries had been committed by youth, but because the suspects may be juveniles, he could not give further information. He encouraged citizens to contact the sheriff’s office with any information. “If they see any kids out at night looking suspicious, we’d appreciate it if they’d contact the sheriff’s office,” he stated. The accident involving the horses was reported on Oct. 24 after the owner, Amy Adams, reported the incident to the sheriff’s office. Officer Gardner responded to the call and upon arriving was told three horses had been killed by a downed power line. According to the incident report, Gardner reported that the line and insulator had broken loose, but had not hit the ground. The three horses lay in a line along the fence. The downed line killed two foaling mares and a gelding. The power company was forced to cut the power to remove the horses, which resulted in the power outage on Friday night. Court Reporter Appearing in Seventh District Court before Judge Douglas B. Thomas on Oct. 21 were: John Allen Schade. Schade faces a Class A Misdemeanor charge of Issuing a Bad Check/Draft Presumption, which he pled guilty to in a plea in abeyance agreement. A review of the agree- ment is scheduled for April 21. Michael Winston Taylor. Taylor faces a Class A Misdemeanor charge of Failure to Stop at Command of Law Enforcement. The defendant did not appear before the court and a bench warrant was issued for his arrest. Main Street Huntington 435-687-9119 that Taylor was incarcerated in the Emery County Detention Center on a judgment out of justice court. His initial appearance was rescheduled for Nov. 5. Noe Prieto. Prieto faces a Third Degree Felony charge of Possession of a Controlled Substance and a Class C Misdemeanor charge of Speeding. He pled not guilty to both charges. A jury trial is scheduled for Dec. 17 and a Suppression Hearing is scheduled for Nov. 17. Casey Ray Tuttle. Tuttle faces two Second Degree Felony counts and one Class A Misdemeanor count of Possession of a Controlled Substance without a Prescription, one Class A Misdemeanor count of Use or Possession of Drug Paraphernalia, a Class B Misdemeanor count of Driving on a Denied License, a Class B Misdemeanor charge of Operating a Vehicle without Insurance and a Class C Misdemeanor charge of Driving without Registration or with Expired Registration. Tuttle waived a preliminary hearing and he was ordered held to answer to the charges and bound over for arraignment. Arraignment is scheduled for Dec. 16. Jeffory Lyne Kirkham. Kirkham faces a Second Degree Felony count of Theft by Deception, which he pled guilty to on Oct. 21 in a plea in abeyance agreement. Jose Vargas. Vargas pled guilty in June of 2005 to a Third Degree Felony count of Possession of a Controlled Substance and a Class A Misdemeanor count of Tampering with R E -ELE CT Evidence. In post sentencing proceedings the defendant’s probation was reinstated for 36 months. He was ordered to serve six months in jail with credit granted for the 76 days previously served. Rachel Annette Wardle. Wardle faces Third Degree Felony charges of Illegal Possession/Use of a Controlled Substance and a Class B Misdemeanor charge of Driving Under the Influence of Alcohol or Drugs. She pled guilty to both charges. In a review hearing Wardle informed the court that she had paid what she was ordered to pay so far. The court found that she was in violation of her plea in abeyance agreement and ordered it set aside. She was sentenced to a suspended prison term for the felony charge and a suspended jail term for the misdemeanor charge. She was fined $1,332 and placed on probation for 36 months. Maurice Joseph Gelpi. Gelpi faces a Third Degree Felony charge of Failure to Stop/Respond at Command of Police, Class B Misdemeanor charges of Unlawful Purcahse by Interdicted Person and Operating a Vehicle without Insurance and Class C Misdemeanor charges of Speeding, Right of Way – Stop or Yield Sign and Driving on a Denied License. Counsel made a motion for a continuance of the preliminary hearing and the motion was granted. The preliminary hearing is scheduled for Nov. 18. Eric B. Sitterud. Sitterud faces a Third Degree Felony charge of Forgery and a Class B Misdemeanor charge of Theft. Counsel made a motion for a continuance of law and motion proceedings and the motion was granted. Disposition is scheduled for Nov. 18. Cody Dale Adam. Adam faces a Third Degree Felony charge of Burglary and a Class B Misdemeanor charge of Theft. In his initial appearance the defendant was advised of his right to counsel and bail was set for $5,000. The court appointed Mark H. Tanner to represent him. A preliminary hearing is scheduled for Nov. 5. Suzanne Moore. Moore faces an amended Third Degree Felony charge of Illegal Possession / Use of a Controlled Substance and amended Class A Misdemeanor charges of Illegal possession/Use of a Controlled Substance and Driving Under the Influence of Alcohol or Drugs. She pled guilty to all charges and waived a preliminary hearing. Sentencing is scheduled for Dec. 3. Felisha Mitcheson. Mitcheson faces a Third Degree Felony charge of Unlawful Acquisition/Possession/Transfer-Card and a Class A Misdemeanor charge of Property Obtained by Unlawful Conduct. Mitcheson waived a preliminary hearing and arraignment is scheduled for Nov. 18. Christopher Seaton. Seaton pled guilty in December of 2007 for a Third Degree Felony count of Theft and in post sentencing proceedings he admitted to three of the allegations against him in the order to show cause and the court dismissed two of he allegations against him. Sentencing is scheduled for Nov. 18. Dick R. Allred. Allred faces a Class A Misdemeanor charge of Stalking. The prosecuting attorney indicated that a resolution had been reached on the matter and the jury trial was cancelled. The defendant suggested a psychological evaluation and the state concurred with the recommendation. The case S Christy’s alon ensations was continued until Dec. 16 to allow time for the proper examinations. Laura D. Ross. Ross pled guilty in September of 2007 to Class A Misdemeanor charges of Possession of a Controlled Substance and Use or Possession of Drug Paraphernalia. In a bench warrant hearing counsel and the defendant addressed the court. The matter was continued until Nov. 5 and bail was to remain at $2,500. Denise Marie Heaps. Heaps pled no contest to a Third Degree Felony charge of Obstruction of Justice on Aug. 19. In sentencing proceedings she was sentenced to a suspended prison term, fined $1,800, placed on 36 months probation and ordered to serve two days in jail. Joanna Hernandez Sanders. Sanders faces a Class A Misdemeanor charge of Burglary of a Vehicle and Class B Misdemeanor charges of Theft and Possession of a Controlled Substance without a Prescription. The defendant did not appear at court and a bench warrant was issued with bail set at $2,500. Julian Lyle Bowman. Bowman faces a Second Degree and Third Degree charge of Criminal Mischief, a Class A Misdemeanor charge of Reckless Burning and a Class B Misdemeanor charge of Electronic Communication Harassment. The prosecutor made a motion for continuance of the preliminary hearing and the motion was granted. The preliminary hearing is scheduled for Nov. 17. Bowman also faces a Second Degree Felony charge of Retaliation Against a Witness/Victim/Informant and two Class B Misdemeanor charges of Disorderly Conduct. A preliminary hearing on those charges is also scheduled for Nov. 17.
