Show SHOOTING AT GARFIELD shortly after 2 a in july 12 garfield beach was the scene of a shooting affray which resulted in the killing by john C de la mare sheriff of thoele tooele county of wm J ryan byan a gambler and sporting man while au attempt was being made to arrest the latter the affair grew out of a quarrel over a woman known as libbie duncan formerly libbie lee whom ryan byan was in COM company pally with he had struck a man named wood and had also struck the woman several times knocking her down once wood complained to the sheriff at the same time warning him that ryan byan would probably shoot if an attempt was made to arrest him the officer cabled ailed assistance to take ryan byan into custody and had the train held while search was being made at last apt the man was discovered in the back seit of the rear car and the officers went in sheriff de la mare stepped into the seat in front of ryan byan and mrs mra duncan followed by deputy sheriff john B gorjon ex sheriff mcbride went into the same seat with ryan byan while mrs duncan stepped out and moved forward to another seat the sheriff remarked 4 to ryan byan you are my prisoner when the latter who had been watching mcbride turned and raised his revolver pointing it at the sheriff at that instant a shot was fired and mcbride and gordon believed it was from ryans revolver as they fully expected he would make buch an effort they seized him 3 not having had the opportunity port unity before but he fell back and dropped his weapon while the blood coming from a wound just below the left cheek bone showed that he had been shot A doctor was telephoned for to this city and the train started arrivi arriving bg at am but ryan died just before the jordan river was reached sheriff de la mare came to the city gave himself into the custody of sheriff burt and was placed it in the county jail pending the investigation ti by the coroners jury THE INQUEST ryans body having been taken to undertaker joseph wm taylors an inquest was waa held there by coroner george J taylor the wound was probed by surgeons who found that the bullet had bad ps passed d directly in from where it entered to the base of the skull on the same side ot of the head after the he examination of the body the inquiry was proceeded with and CHAS B R BRIDE was the first witness he testified 1 I was sheriff of tooele thoele county but am not now hold no official P po 0 this morning about 2 at garfield a man named wood came cam running up the platform platform to sheriff de la mare ant and myself who were talking and said that in the bick back car a man had slapped a woman wood had protested and the nao had bad slapped him and said you g of a b get out or ill all shoot you wood then turned and was followed follows out by the man who kicked wood warned us that the mao was a desperate character the sheriff heard woods woodis story and then asked me to go and help him the sheriff said he had only a popgun a seven shooter I 1 said we could take the watchman and we w did so the train then pulled aled out ouk I 1 and turned on the Y t apropo propose that the sheriff and watchman 90 g in one way and I 1 the other the man was in the back WA seat t the sheriff got in first when I 1 9 got atthe there the man had his gun in h his is band and and I 1 caught him on the shoulder he straightened up in the seat slid 1 a shot was fired I 1 thought it wao wa f the man who had shot the sheriff sherif ii f who was in front the man then fell fe back and I 1 knew it was him I 1 sup say posed sed even then that it was ae out he be lived till we v got to the jordan when the sheriff beri said to him you are WC prisoner I 1 arrest you for disturb disturbing the peace he straightened up NJ did not rise out of his seat seata thought he had shot the sheriff expected he would shoot and adaar had been warned that he was a dog de character after the shooting somebody said ryan byan is shot someone else asked who did it similar circumstances cum stances mr gordon the deputy sheriff picked up ryans byans pistol when uen it dropped saw the woman nibble duncan whom ryan had slapped was about three seats ahead in t the e car after the shooting ryan byan never spoke after he was shot I 1 had bad no 0 o weapon on me I 1 dont think htyan was conscious after he was snot there was no light in the car ow but the light from duncan later in the even mia anen W hen the time came to leave duncan took ryans byans arm and the whey y went to the train I 1 went on car and add p pd aid no attention to aw to before getting to the fiato he ne beut away again we w got on the car in the car he began to te use the vilest of language to her I 1 had ever heard she tried to pacify him he said he wanted to talk to me and I 1 said I 1 did not want to quarrel he turned to her and slapped her then he drew his pistol and ordered me out of the car as I 1 was going he kicked me I 1 then went to the officer and told him what had been done the brakeman pointed the officer out to me I 1 asked for ryans byans arrest and and cautioned the officer a number of times I 1 did not go in the car when the officers did for fear ryan byan would shoot me I 1 saw no gun till ryan byan raised up to me I 1 had not to him he said YOU s b get out of here I 1 never spoke to ryan byan before last night met mrs duncan once before she was short dark complexioned I 1 reside in philadelphia intended going away this morning mr rose was with me when ryan byan assaulted me JOHN 13 GORDON testified I 1 am deputy sheriff of tooele thoele county was present this morning when the shooting occurred I 1 know of no additional facts to those given by McBride Mr his statement is correct I 1 saw ryan byan rise up and was watching him closely forI for I 1 expected to see him shoot heard the sheriff say to ryan byan you are my prisoner ryan byan straightened up and raised his pistol pointing it directly at the sheriff at this instant the shot was fired here is the pistol the weapon a 41 caliber colt self acting was exhibited five chambers were loaded and C one ine empty the sheriff called me to assist him and said he understood the man was a tough citizen I 1 supposed at first that it was ryan byan who feed the shot he lived about an hoar ha the sheriff sherli was justified in ila shooting ryan byan evidently intended to shoot him I 1 think I 1 would have shot ryan byan under the same circumstances like to be in the same fix as he was then B E A FRANKS deputy marshal te testified stifled I 1 knew wm win J ryan byan the deceased arrested him on a charge of alg highway way robbery four or five months ago he was afterward indicted and was put under bonds he had not been tried for the offense R H ROSE test testified fied I 1 reside at omaha was an eye witness to the circumstances detailed by mr wood his statement is true I 1 was not in the car at the time of the shooting when ryan byan struck wood I 1 tried to pacify the former saw ryan byan draw bis pistol on wood he hd said to the woman you ride with me alone or ill clear the whole d car out I 1 girled to pacify him and hebald he said rose bose this is my funeral 5 and leave me alone alon eoll he had not been drinking drin kine to any extent I 1 had spoken to him many times and was quite friendly with him if he had been threatening threatening threat enin 9 me I 1 would have been afraid of him he was very angry we were all in bathing ryan byan remained with mrs duncan in her dressing room till she was dressed they came out of the water together when he used bad language she tried to pacify him he had his revolver vol ver in his breast pocket DIR BIB WOOD was recalled and said I 1 heard ryan say there were not men enough on the train to prevent him going home with the woman I 1 was impressed with the idea that he would shoot and told the sheriff so three or four times MRS duffin was not present at the inquest so the jury went to a house east of the metropolitan hotel this is not her home which is near the corner of third south and west temple streets but is the same house in which ryan byan was lodging there she was found confined to her bed she was sworn aud and made the following statement I 1 was at garfield last evening came back bach on the last train early this this morning went out with mrs Ry anRose wood and others there was present at the time of the shooting my mind is clear at present but I 1 a am m n nervous I 1 remember wk what took p place lace heard heard ryan use severe language to wood the latter was quiet he gave no provocation to ryan byan ryan struck me outside of the car he knocked me down I 1 was not hurt badly then though he hit me hard he pulled me off the train after that and struck me in the eye he was very angry I 1 thought he had been drinking he be again struck me after we got on the car mr wood was present at this time P ryan byan spoke to him wood said he wanted no trouble ryan struck wood drew a gun and then kicked wood out of the train ryan byan pulled me off the train an and asked me to have a drink but I 1 refused he made vae me get on the train again and we sat on the same seat at the back AA of the car I 1 told him I 1 would not have him disgrace me before my friends he said he knew he was a fool when he was drinking while we were in th the e seat the offic officers Gra came in I 1 made room for them to pass I 1 I 1 did not have time to explain anything before the shot was fired heard sheriff de la mare say my god boys I 1 have shot him but I 1 mean to I 1 was not looking at ryan by an when the officers came in so did not see his revolver then 1 I moved out when the officers came in did not hear anything said did not hear the sheriff say you ou are my prisoner I 1 was too disgusted with ryan byan to watch what he was doing I 1 know the officers well saw mcbride grab ryan byan just as the shot was fired I 1 think de la mare also made a grab at ryan byan gordon was between ryan byan and 1 I de la mare was immediately in front fron t of ryan byan on the next seat mat I 1 went to a seat farther ahead mcbride remained with byan ayan till till we got to the city heard ryan byan say that there were not enough men on the train to prevent him going home with me he said he would clear out the train said so much I 1 cannot remember it I 1 was well yesterday I 1 am not suffering from the blows from mr ryan byan but from the nervous shock at the time of the shooting there were some other parties in the car who had words with mr ryan byan THE VERDICT xit the testimony being closed the jurors retired for consultation and agreed upon the following verdict territory OF UTAH county of salt lake J an inquisition holden at joseph wm in the second precinct of salt lake cit city on the day of july 1889 beare before george J taylor coroner ot of said county upon the body of william J ryan byan there lying dead by the jurors whose names are hereunto subscribed the said ade jurors u bors on their oaths do say aay from the evidence presented that he died on a mr ciar of the utah nevada lR railway allway between black rock bock and jordan river biver in salt lake county at about a m july 12 1889 from the effects of a pistol astol shot fired from a weapon in the the hand baud of john C do de la mare sheriff of tooele thoele county in self de
