Parley P Pratt petitioned the Council not to permit the opening of a rod four-rod street through his land he be alleging that he had been in possession of the property for many years and that when he came in possession of the property no street was laid out as was shown by old maps He made many citations to show that the Council had right to open said street Referred to the I committee on streets with the city attorney associated Hyrum W Kimball and others represented that they had hel held certain certain certain tain property for thirty y years rs and asked that a perfected title be grant residents de dents ntH on streets where it was waR first sought to obtain a franchise and where the people are almost unan unan- unanimously unanimously unanimously opposed to it and many of the petitioners sign signed for tear that the road might be built on their own street This being the status of the community's community sentiments or that portion of it affected or su supposed to be affected by the roads while the committee are in favor of the building of railroads and the he growth and progress of the community they are not in favor of granting the franchise in question so long as such a majority of the people interested are opposed to it and until there is is- greater necessity for fora fora fora a railroad there In reply to the argument that thata a franchise had been granted d on the south end of the same street the report says that it was urged that the petitioner wanted to get in the locality of the other railroads f for forthe forthe r the interchange of business bu but t this argument bad no force in the toe the other application If the commercial needs of the city demanded it if there could be found a way out of the city that would be less objectionable but for the present the committee re- re recommended recommended re recommended commended that the resolution be indefinitely postponed I After the was read Coun Coun- Councilor Councilor Smith arose and said that he was a member of the committee but did not sign the report because he did not feel assured of the feelings of the majority of the population ACcording to his understanding rods frontage favored the franchise opposed it and 80 rods were neutral I If f these are the honest facts they should be heeded He then said that there were gentlemen present with notarial evi evidence ence who should be heard 3 Alderman Riter stated that the committee had driven to every house and secured the opinions of the residents and that the report was correct as
