Serviceman refers to both officers and enlisted personnel. Circumstances whereby a serviceman can run for a Government office depend on status Regular Component or Reserve Forces. A member of a Regular Component, while on active duty, may accept a nomination for public office if the nomination is offered without direct or indirect activity on his part. He may then file such evidence of his candidacy as is required by local law. A MEMBER of the Reserve Forces, while on active duty, may become a candidate for electin' without the offer of nomination. Should a serviceman be elected to certain Federal or State offices, he may be discharged, relieved from active duty or resign, as appropriate. However, a military member, generally will not be separated for the purpose of running for public office. In addition, the candidacy of a serviceman must not interfere with the performance of his military duties and, if elected, he cannot perform any duties of his public office while on active duty status. A MEMBER of the military service is not permitted to participate in any way in political management or political campaigns. This prohibition includes activity at political conventions or on political committees, political speeches, publication of articles, or ' any other public activity looking to influence an election. On the other hand, a serviceman retains the right to vote, to express his opinions privately and informally on all political subjects and candidates. When expressing a private opinion, he may not purport to speak on behalf of the armed forces or significantly prejudice important interests of the United States.
