Show I CONSTITUTIONAL AMENDMENT No 3 I A JOINT RESOLUTION PROPOSING PROPOSING PROPOSING PRO PRO- POSING TO AMEND ARTICLE ARTICLE ARTI ARTI- CLE XIII SECTION 2 OF THE CONSTITUTION 0 OF F T THE II H E ESTATE ESTATE STATE OF UTAH RELATING TO TANGIBLE PROPERTIES EXEMPT FROM TAXATION Be De it resolved by the Legislature Legislature Legisla Legisla- ture of the State of or Utah two two thirds thirds of all members elected to each of the Houses voting in favor thereof Section 1 It is proposed to amend Article XIII Section 2 of the Constitution of the State of Utah to read as aa follows Section 2 2 All tangible property property prop prop- erty in the state not exempt under the laws of the United Stat States s or under this constitution constitution tion shall shaH be taxed in proportion proportion proportion tion to its value to be ascertained ascertained ascer ascer- tamed as provided by law The property of the state counties cities towns school districts municipal corporations and public pub pub- lie lic libraries lots with the buildings buildings build build- ings thereon used exclusively for either religious worship or charitable purposes and places of burial not held or used for private or corporate benefit shall be exempt from taxation Water Vater rights ditches canals reservoirs power plants pumping pumping pump pump- ing plants transmission lines pipes and flumes owned and andu u d by individuals or corporations corporations corpora corpora- for irrigating lands within the state owned by such individuals individuals or corporations or the in individual individual in in- members thereof shall not be separately taxed as long longas as they shall be owned and used exclusively for such purposes Power plants power transmission transmission sion lines and md other property used for generating and delivering erin ering electrical power a portion of which is used for furnishing power pumping water for irrigation in-i- in gation g purposes on lands in the State of Utah may be exempted from taxation to the extent that such property is used for such purposes These exemptions shall accrue to the benefit of the users of water so pumped under such regulations as the legislature may prescribe The taxes of the indigent ent poor may maybe maybe maybe be remitted or orr abated at such times and in such manner as may be provided by law The legislature may provide for the exemption from taxation of homes homesteads and person person- al iii property not to exceed 2000 in value for homes and homesteads and all household furnishings furniture a and n d equipment used exclusively by the owner thereof at his place of abode in maintaining a home for himself himsel and family Property Proper Proper- ty not to exceed in values value owned by disabled persons who served in any war in the military mill mili tary service of the United States or of the State of Utah and by the unmarried unman widows and minor orphans of such disabled dis dis- persons or of persons who while serving in the military service of the United States or orthe orthe orthe the State of Utah were killed in action or pr died as a result of ot such service may be exempted as the legislature may provide The legislature shall provide provid by law for an annual tax sufficient with other sources of revenue rev rey to defray the estimated ordinary expenses of the state for each fiscal year For the purpose of paying the state debt if any there be the legislature legislature legislature legis- legis lature shall shan provide for levying a tax annually sufficient to pa pathe pay the annual interest and to pa pathe the principal of such Buch debt with within in twenty years vears from the final fina passage of the law creating th the d debt L J Se Section tion 2 2 The secretary o oi state is directed to submit thi proposed amendment to th tha electors of the State of Utah in the next general ele election tion I Ithe in inthe inthe the manner provided by law 1 I Section 3 If adopted by the bel electors of this state thin thit amendment shall shan take effect the thu first day of January 1963 J 1 JI I r LAMONT F.
