Show CONSTITUTIONAL AMENDMENT No 3 I A JOINT RESOLUTION PROPOSING PROPOSING PROPOSING PRO- PRO POSING TO AMEND ARTICLE ARTICLE ARTICLE ARTI ARTI- CLE XIII SECTION 2 OF THE CONSTITUTION 0 OF F T THE H E ESTATE ESTATE STATE OF UTAH RELATING TO TANGIBLE PROPERTIES EXEMPT FROM TAXATION Be Bo it resolved by the Lc Legislature Legislature Legisla Legisla- isla- isla ture of the State of Utah two two thirds thirds of all members elected to each of the Houses voting voting- in favor savor thereof Section 1 It is proposed to amend Article XIII Section 2 of ot the C Constitution of the State of Utah to read as follows Section 2 All tangible ible property property prop pro erty in the state not exempt under the laws of the thc United States or under this constitution constitution tion timi shall be taxed in proportion proportion proportion tion to its value to be ascertained ascertained ascer ascer- tamed as provided by law The property properly of the state counties cities towns school districts municipal corporations and public pub pub- lie lic libraries lots with the buildings buildings buildings build build- ings thereon used exclusively for lor either religious worship or charitable purposes and places of burial not held or used for private Oate or corporate benefit shall hall be exempt from taxation Water Vater rights ditches canals reservoirs power plants pumping pumping pump pump- ing plants transmission lines pipes and flumes owned and used by individuals or corporations corporations corporations corpora corpora- for irrigating lands within the slate state owned by such individuals individuals or corporations or the in individual individual individual in- in members thereof shall not be separately taxed taxed-as long longas as they shall be owned and used exclusively for such purposes Power plants power transmission transmission sion lines and other property used us-ed for generating and delivering ering electrical power a portion of which is used for furnishing power pumping water for irrigation fri irli- gation purposes on lands in the State of Utah may be exempted from taxation to the extent that such property is used for such purposes These exemptions shall a accrue crue to the tho benefit of or orthe the users of or water so pumped under such regulations as the legislature may prescribe The taxes of ot the indi indigent ent poor may maybe maybe maybe be remitted or abated at such times and in such manner as may be provided by law The legislature may provide for the tho exemption from taxation of ot homes homesteads and person person- al at property not to e. e exceed cee 2000 in value for homes and homesteads and all household furnishings furniture n a and n d equipment used exclusively by the owner thereof at his place pace of ol abode in maintaining a home for himself and fatally family Property Proper ty not t to exceed in value owned by disabled persons who served in any riny war in the military military mili mill tary service service of the United States or of the State of Utah and by the unmarried widows and amI minor orphans of such disabled disabled disabled dis dis- dis- dis persons or of persons who while set serving ng in the military service of the United States or orthe orthe orthe the State of Utah were killed in action or died as a result of such service may be exempted as the legislature may provide pro The legislature shall provide by law for an annual tax sufficient sufficient zulu zulu- dent with other sources of revenue revenue revenue rev rev- to defray the estimated ordinary expenses of the state for each fiscal year For the purpose o of paying payin the state debt if any my there be the legislature legis legis- lature shall provide for levying a n tax annually sufficient to pay the annual interest and to pay the principal of such debt with within within in twenty years from the final passage of the law creating the debt Section 2 The secretary of state is directed to submit this proposed amendment to the electors of the tho State Slate of Utah in the next general election inthe in inthe inthe the manner provided by law Section 3 If adopted by tho electors of this state this amendment shall take efe effect t the first day lay of January 1963 I LAMONT LAi F.
