Show I CONSTITUTIONAL AMENDMENT A JOINT RESOLUTION PROPOSING PROPOSING PROPOSING PRO PRO- POSING TO AMEND ARTICLE ARTICLE ARTICLE ARTI ARTI- CLE XIII SECTION 2 OF THE CONSTITUTION 0 OF F T THE H E ESTATE STATE OF UTAH RELATING TO TANGIBLE PROPERTIES EXEMPT FROM TAXATION Be it resolved by bythe the L Legislature Legislature Legis Legis- gis- gis lature of the State of Utah two thirds of or all aU members elected elected elect elect- ed to each of or the two houses voting in favor faor thereof Section 1 1 It is proposed to amend Article XIII Section 2 of the constitution of the State of Utah to read as s follows All tangible property in the state not exempt under the laws Jaws of tho the United States the State of Utah or under this constitution shall be taxed in proportion to its value to be ascertained as provided Pro b by law The property erty of the state counties counties coun coun- ties tics cities towns to school districts districts districts dis dis- dis- dis municipal corporations and public libraries lots with the bu buildings s thereon used ex exclusively exclusively ex- ex for either religious worship or charitable purposes and places of burial not held or used for private or corporate benefit shrill shan be exempt from taxation Water rights ditches canals reservoirs power plants plants transmission lines pipes Ipes and flumes owned and used b by Individuals or corporations corporations cor cor- for irrigating lands within the state owned by bv such individuals or corporations or orthe orthe orthe the individual l members thereof shall not be separately taxed t. as long as they shall be owned and md used exclusively for such pur pur- poses Power plants power transmission lines Jines and other property used for generating delivering electrical power a portion of which is used for furnishing power for pumping water for irrigation purposes on lands in the State Stale of Utah malbe may mal maybe maybe be exempted from taxation to the extent that such sueh property is used for such purposes These c exemptions cm shall accrue to the benefit of or the users of or water BO so pump pumped d under such regulations regulations regula regula- ions as the legislature may prescribe The taxes of or the indigent indigent indi indi- gent poor ma may be remitted or abated austed at su such h times and in such manner as m may be provided by br law The legislature may pro- pro ride nde for the exemption from taxation of homes homesteads and personal property not to exceed 2020 in value alue for 01 homes and homes homesteads ads and all household furnishings furniture and equipment used exclusively by tho the owner ovner thereof at his place of abode in maintaining a home for himself and family Property not to exceed 3 in value owned by disabled persons who served in any war warIn warin in 10 the military service of the United States or of the State of or Utah and by bf the tho unmarried widows and minor orphans of such disabled persons or of or persons persons persons per per- sons who while serving in the military service of the United States or the State of Utah were killed in action or died as ns asa asa a result of such sen service ce may be exempted as the legislature may provide The legislature shall provide by bj law for an annual tax sufficient sufficient clent with other sources of revenue to derra defray the estimated ordinary expenses of or the State for or each fiscal year For the purpose of paying laying the state debt if any there be the legislature legis legis- lature laturo shall provide for levying a tax annually sufficient to pa pay tho the annual interest est and to pay the tho principal of or such debt within wIthin within with wIth- in twenty years Jears from the final passage of the law creat creating n the debt Section 2 The secretary of state is directed to submit this proposed amendment to the electors electors elec dec tors of the State of Utah in the next general election in the manner provided by law Section 3 If adopted b by the electors of ot this state this amendment nt shall take effect the first da day of or January 1961 I LAMONT F.
