CASE Judge Maglnnia wu today retained to art aa senior counael In tho defense of Patsy Dwyer, who killed a man named Wlllism In Austin. Nev., last year. Dwyer mix took Williams for an other man and allot him by mistake. This rase has become famous by reason of the contempt proceedings now being heard before the supreme court of Nevada. When Dwyer's case came up for trial la the district court at Austin he asked for a change of venue from Austin to Elko, and his petition was denied by Judge Breen. He appealed to the supreme court and the decision of the lower court was reversed. District Attorney Maestrettl of Austin became quite Indignant when he heard of the decision of the supreme court, and expressed himself la strong language In open court. Judge Breen endorsed the remarks of the district attorney. The matter was called to the attention of tho Judges on' ths supreme bench and they immediately cited Judge Breen and the district attorney to appear and show cause why they should not be disbarred from practicing In the state of Nevada, as being in contempt of court il.e wheels of a westbound freight.
