The matter was referred to Chairman Stanford and the county attorney for elucidation. The resignation of O. S. Stratford made application to be appointed awter commissioner of the Weber river system. Commisslolner Wilson reported that they were preparing to clean the roads in South Fork and Beaver canyons. Harvey Brown, the road supervisor of Huntsville, Is on a still hunt for the owners of flocks of sheep that have recently traveled through the canyon and said to have damaged the road. He desires to assess and collect the damages. The board ordered the erection of a sprinkling tank in the canyon at the Oaks resort. The facts of the terrible affair as related by Lynch In a dying statement to Coroner Howell are as follows: Lynch had Just served a term In the city jail for vagrancy. On Saturday night he and a companion, an elderly man who Is known as "Fatty, cllmbfed In to the top of a refrigerating car, Intending to beat their way east When near Roy the brakeman came along and demanded fifty cents from the men. They told him they had no money and he told them to get off. The brake-ma- n continued on to the head of the train and In the meantime Lynch crawled Into the refrigerating box on the top of the car. When the brakeman returned he fired a pistol shot at the box. Lynch then emerged from his hiding place and the brakeman started to put him off and In the struggle threw him between the cars, he landing on the rail and the cars passing over him as described. The train was stopped and the Injured man carried to the caboose. He was taken on to Layton and there was placed on board a passenger train and brought to Ogden. At the hospital everything possible was done for him, but no hope Is entertained of his recovery. In private Lynch told the foroner his true name and requested him to communicate with a sister In the east Diligent search has been made by the sheriff and his deputies for "Fatty," the old man who accompanied Lynch, but so far without success. Deputy Sheriff Sebrlng went to Salt Lake yesterday but failed to locate him there, and It Is surmised that the trainmen have carried him on east and that now he is hundreds of miles away. With Assaulting Loyal West Carl Carlson Fined for John Doe Van Darling, a Hollander, was fined 29.60, the cost for witnesses. In Judge Howell's court this morning for striking and kicking little Loyal West Loyal and several of his little friends had been throwing apples at one of Mr. Van Darling's dapghters and the latter proceeded to take the law in hla own hands and beat the boy. Van Darling has been in this country but a few months and as he Is unacquainted with the law hla punishment was made as light as possible. He was given a warning, however, that hereafter he is to notify the officers and not begin to do the punishing act himself. The boys were likewise given a talking to. Mabel Hedspath was arraigned on a charge of having been drunk. Her hearing was set for tonight Mabel has been before the Judge on several previous occasions. Jessie Frell .also charged with having been drunk, was discharged as she promised to be a good girl. Jessie had been troubled with stomach complaint and accidentally took an overdose of ginger and whisky. That Is her story. George Harris, Walter Reid and B. Flynn, who celebrated their coming In from the cut-oby getting drunk, were discharged. Charles Treman and Frank Smith, two vagranats, were given ten dnys each.
