Show ; f DAILY UTAH STATE CHIEF BROWNING SPRAY TREES III SUED FOR CITY HULL PARK COULD BE SAVED BY SMALL PENDITURE. V LOCAL BRIEFS Chief of Police Browning was made the defendant in a suit filed in the Second district court today by A. Maillard to recover $5,000 damages for unlawful arrest and detention. D. S. Truman of Salt Lake is attorney for the plaintiff, of which place Maillard is evidently a resident The complaint alleges that on the 31st of March Chief Browning swore to a complaint charging him with vagrancy and that he did so maliciously and without true cause. Subsequently Maillard was arrested and imprisoned in the cHy Jail for four days. He was then brought before Judge Howell, tried and acquitted. His case received great publicity through the Herald and Tribune of Salt Lake and th I'tah State Journal and Standard of this city which w.u through procured, plaintiff believes, the defendant. He alleges that he paid $100 for attorney's fees and costs and suffered in his good name, reputation and business to his damage to the extent of $5,000 for which he asks Judgment. !: .5. t ,'f In Railroad Circles H. The preliminary examination 'of Martin Smith, charged with an at tempted crimnlal asault on Annie Voss, the little girl of Herman Voss, was called In the municipal court this afternoon at 2:30 oclock. He was rescued from the river clothed and by Constable Millard, to the county Jail, where he brought now la. When examined by Dr. Forbes this morning he appeared more rational and it is believed that in a day or two he will completely recover from his .mental aberration. He is an employe of the Short Line and received his money on the 23d. Then he and another two started out to do things up a la railroad style. They continued doing for three days and then Benson thought he would seek the seclusion of Farmington and try and sober up. That he failed in his resolution is evident, for the last he remembers is being in a railroad camp at Utah's Cfretna Green. Then the delusions must have begun. He claimed he had a watch that always warned him against danger, and attached to it waa so long that it would atretch from Ogden to Salt Lake.
