A motion was also filed by her attorneys this morning, for the return of the furnishings of fourteen rooms, which were torn up by the sheriff on the plaintiff's order and stored in two rooms, leaving Mrs. Werts with fourteen rooms bare of furniture. Started Over Lease. The trouble all started several weeks lease to a furn ago, over a one-ye- ar iahed rooming house on Grant avenue between Twenty-fourt- h and Twenty-fift- h street which Mrs. Werts held. G. T. Terry, the owner of the room lng house, gave hie tenant notice to vacate the premises and upon herwe fusal eo to do, started a civil action to have her ousted. This eras contested by Mrs. Werts and the landlord took a change of venue in the case. Meanwhile, it was claimed that he had become angered, gone to the house one night, and eat upon the steps until two o'clock In the morning, in an effort to prevent roomers from entering. Then, it waa said, Mrs. Werts drove Terry from the place by striking him In the face with a broom. Charged With Immorality. Mr. Terry then filed Ji criminal charge In police court, against hie tenant, charging her with keeping a house and with immoral conof warrant was issued for her duct. arrest, she appeared for trial, but the plaintiff, Mr. Terry failed to put In an ill-fa- appearance in court until a few utes after the case had been mindis- missed. He then desired to awpar out a second complaint, of a similar nature, but City Attorney Devine refused hie request, because he held that toero waa no evidence against the woman. Task Her Furniture. Still determined to oust hie tenant. Terry, through his attorney, J. D. Skeen, had the furnishings of the house, pending the settlement of the care in court, which attempted to oust Mrs. Werts, taken in charge by Sheriff Wilson. A motion was made today to redeliver the property to the woman. Now comes Mrs. Werts and alleges that the complaint charging her with waa maintaining a bouse of falsely and maliciously sworn to, that the eald false chargee were published in the newspapers, and that because of the unlawful prosecution, her person, occupation and good name were Injured to the extent of 810.000. She further alleges that counsel fees amounted to 81.000 and neks that Judgment against Terry for 811.100 and costs of suit be awarded her by the court.
