Carol is also in a shopping mood. half-pric- e; She knows that Bob gets paid today and, with all! the sales going on, it is a good time to shop. Bob and Carol enjoyed showing each other their Bob purchases, showed his tool kit and Carol and the kids modeled their clothes. The enjoyment short-live- d. MONDAY, OCTOBER 29, 1973 72 Do-It-Yours- i divorce has its Banking Year ing tool because the big question is how and when do I pay it off 7 The objective of the schedule is to equalize payments between paydays. In the example, the end of the month payday has twice as much margin as the first payday. Bob and Carol can either apply the difference to reduction of unpaid bills, or they can shift some of the bills from the 15th to the 30th so that the total margin of $199.00 is equally distributed. The margin line item is the amount available for new purchases or new borrowing. Bob and Carol should have referred to this item and agreed on who could spend what portion for clothing or tool kits. Had they done so, the fight would have been over who spends what rather than over who spent too much. - WASHINGTON The (UPI) another was year outstanding year for mortgage banking according to an industry 1972 survey-conducte- annually by the Mortof America (MBA). It would have to be an uncontested divorce, and the party filling out the forms would need to e possess intelligence to figure out what to put down. Otherwise, chances of the job being botched are considerable. . .even with the help of counseling services staffed by laymen. Parties might believe themselves to be divorced, and not be. As the Supreme Court of Florida said last March, in enjoining the operations of lay divorce consultants, Law like medicine, can result in unsuspected complications from home remedies. Whenever confusion and error above-averag- are introduced into the' legal system, such becomes a legitimate concern of the legal profession. It's understandable, ly day's spending spree, there just wasn't enough money. Carol, you know we have to pay the utilities and the house and car payments. Why did you spend so much on clothes? "Well, what about all of the goodies you got!" Carol retorted. And the longstanding fight over money was underway again. Bob and Carol have been married for six years but they still havent k conquered their attitude that the was their personal property. They just never thought that the other partner might have some need for it too. To make matters worse, they seldom considered the possibility that current bills might soak up a substantial part of the check. Why is it that some couples constantly. have money problems? Inadequate income is the problem in many cases; but couples with large incomes also have money problems so maybe the real problem is that people just live beyond their means. Living beyond your means is understandable when you consider the constant barrage of advertising telling us about America's progress and oppor-tunitYour peers appear to enjoy a good standard of living and you have the same education and job status. So you live on tomorrows promises; and, it is easy in our credit card economy. But lets be realistic. Someday you are going to have to pay those bills; and if you have a definite idea of where you are now, and can reasonably predict a source of future income, credit card living can be workable. But it does not come naturally, as riob and Carol well know. Once you admit that you only have so much spending power, you can work out your money problems. Having made pay-chec- y. that admission, you can start eliminat- ing .your problem by determining where you are now and where' you expect to be in the near future. A good way to make that determination is a schedule of payables. The schedule can cover as many pay periods as you care to project, but a one month period is recommended. The features are a total listing of payables, the amounts which can be paid each payday and the balance left unpaid. The amount of debt paid each payday is determined by subtracting living expenses from net pay. The balance unpaid column is an informative work House payment Savings transfer Car payment Bank loan Estimated Bank Service Charge mendable, that the State Bars ot California and Michigan, as well as Florida, have brought actions to enjoin laymen from acting as divorce counsellors. There's good reason for concern on the part of the legal profession. But is the public apt to recognize the validity of this concern when it knows that lawyers also have a personal financial stake in discouraging the Lights Mountain Fuel Supply Water & sewer Telephone Milk Bill TOTAL GRAND TOTAL Living Expenses: approach? The Detroit Bar Assn, has come to grips with this problem. A suit brought by the state bar resulted in lay divorce consultants being put out of business in Wayne County (where Detroit is situated). The cal bar is now demonstrating that its opposition to the lay advisors is not simply based on lawyers' greed. As of October 1, low-codivorce services have been offered by the Detroit bar to persons seeking a 'simple divorce. The centers have been requested to include services for the deaf and the com- - well-state- d County Circuit Court. The opinion said; ' Lay persons, like (the) defendants, who believe that the matter of obtaining a divorce in this state is simply a matter of completing and filing forms are greatly mistaken. Unfortunately, the consequences of their misdirection can and often does affect the lives of others, not to mention the adverse effect it can have upon the administration of the law. A related concern is the Sale of sets of court forms divorce kits with instructions on how to fill them out. proponents point out that the various kits on the market do advise that in complicated cases, an attorney should be consulted. The bars' view, however, is that such a warning is insufficient to alert the user to possible complications which would not be apparent to him. Whether the publication and sale of these kits constitutes an authorized practice of law, or are protected by the First Amendment, is subject to debate. The kits have been banned by court decisions in the states of New York and Nevada. In Texas, the State Bar Committee on Professional Ethics has decreed that attorneys may not sell divorce kits to their clients. This was based on a canon, which provides that the legal profession should help members of the public to recognize the legal problems themselves in matters having legal consequences.
