It has therefore become final and should not under ordinary be circumstances subject to any further attack. A collateral assault upon the judgment can properly be made only if some extraordinary circumstance exists, Such as that the court had no jurisdiction, the wrong person was prosecuted, or some other such circumstance where the processes of justice were so entirely distorted that it would be unconscionable not to review the conviction. The further obstacle in the plaintiff's way here ia that there has already been one such attack upon the judgment in a habeas, corpus proceeding, upon which there was a plenary hearing and adjudication. When one such collateral attack has been made, the judgment under attack should, a fortiori, then be final; and this should be true both as to issues tried, and aa to any other issue which was known to the petitioner, or should have been known to him at the time of that proceeding. It should be obvious that solidarity in and respect for the law demand that this be the rule and that the adjudication must become final sometime. As to petitioner's second contention: not unexpectedly, he attempts to take advantage of the fact that the court reporter did not find and transcribe his notes of the hearing at the time of hie original plea of guilty; and he indulges in the common fallacy of assuming that the trial judge was obliged to believe his testimony as to what occurred and hie understanding as to his rights. He was at that time represented by Mr. L. G. Bingham, an attorney competent and experienced in criminal matters. He testified that while he had no specific memory of these incidents, it is his invariable practice: to discuss the seriousness of thecharge with hisjdients, especially in felony cases; to talk over the particular elements of the crime and relevant court procedures; that he had nevier allowed anyone, including petitioner, to plead guilty to a felony if he claimed he was innocent; that he had never promised anyone, including the petitioner, that he would get probation. since expired. to T.
