The new system's trust account will not be diminished by that payment; only the account of the Utah State retirement system will be affected by it. But the claims against it are proportionately diminished so that no problem is created there. The provisions of Sec. 26(1) of the new judges' retirement act could not have any bearing in any event on the Utah State retirement act. With regard to the third question, the referenced statute, Sec. 26(1) of the new act, deals with the judges' retirement trust account under the new act and gives the retirement make Warranty Deeds - 201 court judges prior to going into the juvenile court system. If service credit is to be given for such prior juvenile court or city court service, some plan must be made for funding such prior service credit or else the benefits to be granted to judges under the present act would have to be reduced. It would appear that the matter is one for the attention of the legislature since the only apparent means of funding would be a legislative appropriation, and the intent of the legislature should be clear as to the granting of such prior service credit. board the power and duty to -- " . |
