Romney Monday told the Conference of the National Association of Attorneys General in Miami that the Federal Constitution does not require that the Federal Courts have habeas corpus jurisdiction over state prisoners. Romney was a featured speaker at the conference. He talked in favor of legislation recently introduced in Congress which would greatly limit the right of Federal courts to inquire into the custody of state prisoners. Romney said, "The state court judges are just as much obligated as are Federal judges to apply the constitution of the United States in all criminal matters coming before them, and it is evident that they do so." He referred to remarks made by Chief Justice Callister of the Utah Supreme Court at the Utah State Bar Convention last August in which Callister said that Federal judges were no "smarter" than state judges. Romney's office recently made an extensive examination of constitutional limits on curtailing Federal habeas corpus jurisdiction over state prisoners and presented a brief to those attending the sessions.
