"RB The Indictment of Judge McKean by the dLtant press contains three counts, vix: 1. Tbo wresting of a aUlute from iU palpable intent. 2. The conviction of nawkins for a crime which he had no intent to commit, and C. Which there wai no statute against at tho time It was committed. As to tho first of these counts, It Is of record that until some Umo (six monllisj after the passage of said statute by tho Utah Legislature the Mormons who composed that Legislaturo had never named polygamy except to characterise it in almost the identical language of said statute as whorewicked and unlawfornication, dom, ful connection, corruption, confusion, false and corrupt docand abomination, doctrine of devils, a crime, trine, etc., etc. There is nothing in tho stntuto itself to show that those who inado it intended to exempt adultery and lascivious coliab-Italia- n from though termed polygamy, tho penalties therein provided. There was no evidenco adduced on the trial of Hawkins to show that they were polygamists, in theory or practice, or tlat they intended to exempt polygamous adultery or lascivious cohabitation from the operation of the statute, their own lint there is evidence, out-o- f in some to at that and sworn cured mouths, C4ea, and running through a score of years, that they held polygamy to be whoredom, and tho unavoidable Inference U, that they did not intend to exempt that style of whoredom from tho operation of tho statute more thin any other. , As to the second count, urging that llawkins committed the oflenco as a relig ious duty, wo hove no evidence but Mormon aesertion that the Mormons generally practice polygamy as a religious duty; and we hare, on the contrary, leading Mormons, including Joseph Smith himself, denying upon oath for a score of years, that it was a part of their religious belief or practice denying that they cither believed, taught, or practiced It, and denouncing the charge that they did as an atrocious calumny of their enemies, Nowjupposo tlieso men do swear to the contrary, of what weight is 'it?
